The termination of an employment contract for an indefinite period is likely to create conflicts between the employer and the employee. Thus, it is possible for them to foresee, before the dismissal takes effect, a transaction that takes the written form of a transactional protocol. The purpose of such a protocol is to prevent any dispute between the parties. Thus, by signing such an agreement, the employer and the employee undertake to put an end to any dispute. To be valid, the settlement agreement must include effective reciprocal concessions on the part of both parties. Moreover, only what has been stipulated in the final settlement between the parties. Thus, anything that is not the subject of the transaction remains subject to industrial tribunal action.
