You leased a commercial space. You wish to give leave to your tenant but you refuse to renew the lease. You must then pay her eviction compensation equal to the prejudice caused by the failure to renew. The eviction indemnity includes in particular: the market value of the business, determined in accordance with professional practice normal removal and relocation expenses the fees and transfer taxes to be paid for a fund of the same value. The leave with refusal to renew and offer of eviction indemnity must be delivered to your tenant by bailiff six months before the expiry of the commercial lease. You must quote in the leave article L. 145-9 paragraph 2 of the Commercial Code which allows the tenant either to contest the leave or to claim eviction compensation within two years from the date for which the leave was granted.
