The banking ban is a source of  lasting financial complications  . What are the causes and consequences, and what are the possibilities available to users to get out of this often very  embarrassing situation  ?

The causes

Following the issue of one or more NSF checks that your bank has refused to honour, you find yourself banned from banking. The bank then notifies the payment incident to the Banque de France, regardless of the amount of the unpaid check. You no longer have the right to issue checks and must return all your means of payment to your banker. The maximum duration of this ban is 5 years.

How to react ?

The first thing to do is to fund your account: cash, bank transfer… You can also request, exceptionally, a cash facility from your banker. In this case, the banker may charge you the costs of forced passage of the refused check(s). Nevertheless, the latter always has the right to refuse your request and the banking ban is then inevitable.

The results

You are prohibited from issuing checks in all banking establishments in France. In the case of a joint account, it is important to designate the person responsible for the unpaid check from the start of the procedure because otherwise, it is the two account holders who are on file at the Banque de France. The banking prohibition also has other consequences: removal of the overdraft authorization and loss of credit.

Get out of the banking ban

To regularize your situation with your bank, you can pay the amount of the check directly to the beneficiary and ask him to cancel and return the check. You can also directly fund your account by specifying to the bank that the sum is blocked for the reimbursement of the unpaid check. At the same time, the beneficiary must be informed and informed that he can represent the check. It should be noted that during a banking ban, the user always has the right to have a bank account and can benefit from a payment card with systematic authorization. Finally, be aware that the Banque de France may charge you additional fees in the event of a repeat offense.
