Description

The purpose of the pre-electoral memorandum of understanding, drawn up and signed with the trade unions, is to prepare the conduct of elections for employee representatives. The memorandum of understanding must obligatorily provide for: the distribution of staff in the various electoral colleges the distribution of seats in the different categories of staff the organisation and conduct of electoral operations. It is also possible to conclude a memorandum of understanding in the event of a change in the number of colleges or in the composition of colleges in relation to the legal situation. For certain points such as changes in the number and composition of colleges, the memorandum of understanding must be signed by all the trade union organisations that have come forward. The unanimity rule of the unions is therefore required. For the other points, if a union does not sign, the memorandum of understanding will not be enforceable against it. If he allows the ballot to take place in accordance with the protocol, he is deemed to have given his implicit consent. The trade unions, in their unanimity, cannot impose their will on the employer who is a party to the conclusion of the protocol. If only one union shows up, we negotiate with it and its signature is enough.
