IF I AM A MINOR?
If you are a minor, your parents must contribute to your upkeep and education. This includes all food, clothing and accommodation costs. This also includes everything related to vocational training, ie tuition fees. Finally, parents are responsible for medical costs. As a minor, you will not have to justify this state of need. This state of need is assumed because of your young age.
IF I AM IN FINANCIAL DIFFICULTY?
Yes, this obligation is called the maintenance obligation . The latter obliges all the people with whom you have a filial relationship to come to your aid when you find yourself in a particularly delicate situation. This may therefore concern your parents, however, if they find themselves in a complicated financial situation, then you can turn to your grandparents, for example. Of course, you will have to prove this state of need, in particular by the fact that you are unable to subsist through work. In addition, you will have to demonstrate that your income is insufficient to allow you to live in good conditions.
IF I WANT TO CONTINUE MY STUDIES?
Yes, it is about the maintenance obligation. This is the sole responsibility of the parents. It concerns exclusively the education of the child. It does not cease with the majority. In other words, the child who, at the age of majority, leaves the family home, can ask to benefit from this maintenance obligation. The child must prove the real and serious nature of the studies pursued. He must also demonstrate the impossibility of paying for his studies alone.
HOW TO GET THIS HELP?
You can contact the family court judge who is competent to set the amount of the pension paid. Either under maintenance obligation, or under maintenance obligation. The judge will assess this amount taking into account your needs and your parents’ resources. This amount may be reassessed according to the evolution of the child and that of the parents. In the event of separation of the parents, the payment of this annuity does not cease. In this case, child support will be paid directly to the parent who has custody of the child.
