A new construction deprives you of sunshine or obstructs your view… What are your options?
REGULATIONS
Everyone is free to build on their land. The limits are twofold. Firstly, compliance with town planning rules : height of the building, depth, aesthetics, color of the facades… Secondly, respect for the neighbourhood, i.e. not causing exceptional inconvenience: reduction of sunshine, noise pollution, etc.
STEPS TO FOLLOW
You must first go to the town hall to obtain a copy of the building permit file. You can then check whether the town planning rules have been respected. Then, as your simple impression is not enough, you will have to materialize the sudden nuisances with the help of professionals (architects, acousticians, etc.).
THE RESORTS
There are three types of cases: if the neighbor does not have authorization, construction without a permit is therefore illegal and you can report this to the mayor of your municipality or even to the public prosecutor’s office. In the second case, if the building permit has not complied with the regulations, you can request its cancellation from the mayor, or even before the administrative court. If you believe you have suffered damage, you can go to the district or high court, depending on the extent of the damage suffered. The judge will decide whether or not to award you damages.
