Fees
Fees are too often unknown, misunderstood and consequently perceived as arbitrary. The fees applied by Maître DAMY’s office are totally transparent.
Since the promulgation of the MACRON law on 6 August 2015, the fee agreement between the lawyer and his client is compulsory in all matters and for all interventions.
The firm welcomed the entry into force of this law because its policy has always been to be totally transparent with clients from the outset, which is the best way to preserve a climate of trust.
As a general rule, the firm’s fees are established according to the work carried out and the time spent, these two parameters being, of course, a function of the difficulty of the case, but the firm also offers flat-rate fees or fees based on the result.
DAMY’s fees are based on the number of hours of work per case, i.e:
– 360 € TTC / hour of work
INVOICING TERMS AND CONDITIONS
The services of the DAMY Law Firm will be invoiced according to the following terms and conditions:
– For each procedure, an initial retainer is set according to the foreseeable importance of the case;
– The firm will have you sign a perfectly transparent fee agreement which will summarise the services you will need and their pricing.
FEES AND POSTULATION COSTS IN ADDITION TO THE REMUNERATION
For any intervention before the Tribunal de Grande Instance of NICE, GRASSE, DRAGUIGNAN, TOULON, MARSEILLE and AIX-EN-PROVENCE, Cabinet DAMY will apply the legal fees resulting from the law n° 71-1130 of December 31, 1971, the decree 60-323 of April 2, 1960 and more generally from the provisions of the law of July 10, 1991.
For any intervention before the Courts of First Instance outside the jurisdiction of the Court of Appeal of AIX-EN-PROVENCE, the costs and disbursements of postulation will be invoiced directly to the client by the correspondent chosen by Cabinet DAMY.
RESULT FEES, IN AGREEMENT WITH THE CLIENT
At the end of the procedure or the closing of the case by Cabinet DAMY on the occasion of the completion of its mission, an additional fee note will be issued taking into account the result (whether it is a gain for the client or a loss which will have been avoided). These fees are calculated according to a percentage in line with the practices of the profession per tranche of the sum at stake, and invoiced in agreement with the client.
Of course, the result fee will have been previously accepted by the client in the context of the fee agreement.
