background_repeat=&#8221;repeat&#8221; custom_padding=&#8221;13px|||||&#8221; hover_enabled=&#8221;0&#8243; global_colors_info=&#8221;{}&#8221; sticky_enabled=&#8221;0&#8243;]<\/p>\n<div class=\"entry-content\">\n<div class=\"et_pb_module et_pb_text et_pb_text_0  et_pb_text_align_left et_pb_bg_layout_light\">\n<div class=\"et_pb_text_inner\">\n<h2><span>Cos&#8217;\u00e8 l&#8217;incapacit\u00e0?\u00a0(Licenziamento del lavoratore invalido)<\/span><\/h2>\n<p><span>L&#8217;incapacit\u00e0 \u00e8 l&#8217;incapacit\u00e0 fisica o mentale del lavoratore di svolgere il compito affidatogli.\u00a0Questa incapacit\u00e0 pu\u00f2 avere origine professionale (infortunio professionale) o derivare dalla vita quotidiana (influenza, ecc.).\u00a0Viene rilevato dal medico del lavoro che prende la sua decisione dopo aver esaminato la posizione secondo una procedura ben definita con due diversi colloqui.\u00a0La decisione finale pu\u00f2 essere impugnata dinanzi all&#8217;ispettorato del lavoro, che pu\u00f2 essere impugnato dinanzi al tribunale amministrativo.\u00a0In nessun caso il datore di lavoro pu\u00f2 accertare egli stesso l&#8217;incapacit\u00e0 del lavoratore.<\/span><\/p>\n<h2><span>Cosa fare se un dipendente viene dichiarato disabile?<\/span><\/h2>\n<p>&nbsp;<\/p>\n<p><span>L&#8217;azienda deve cercare un inquadramento in azienda o nel gruppo, e trovare un lavoro compatibile con lo stato del dipendente consultando il medico del lavoro che ha l&#8217;obbligo di dare raccomandazioni.\u00a0Se il lavoratore non \u00e8 idoneo, deve essere licenziato entro un termine ragionevole.\u00a0<span class=\"\">Se per pi\u00f9 di un mese non \u00e8 stata avviata alcuna procedura di licenziamento, si dovr\u00e0 riprendere il pagamento della retribuzione se questa era stata sospesa.<\/span><\/span><\/p>\n<h2><span>Quanto costa il licenziamento per incapacit\u00e0?<\/span><\/h2>\n<p>&nbsp;<\/p>\n<p><span>Il costo varia a seconda che\u00a0<\/span><a href=\"https:\/\/travail-emploi.gouv.fr\/emploi-et-insertion\/emploi-et-handicap\/rqth#:~:text=En%20cas%20de%20licenciement%2C%20la,mois%20la%20dur%C3%A9e%20du%20pr%C3%A9avis.\"><span>l&#8217;incapacit\u00e0<\/span><\/a><span>\u00a0sia legata o meno al lavoro.\u00a0Se si tratta di infortunio sul lavoro, la legge prevede che si raddoppi l&#8217;indennit\u00e0 di licenziamento e che si versi il preavviso.\u00a0<span class=\"VIpgJd-yAWNEb-VIpgJd-fmcmS-sn54Q\">Se non \u00e8 di origine professionale vale la solita regola: \u00e8 prevista la corresponsione del TFR, ma niente TFR poich\u00e9 il dipendente non pu\u00f2 lavorare durante il preavviso.<\/span><\/span><br \/><span><span class=\"\">Se il datore di lavoro non intende riqualificare il suo dipendente, il licenziamento \u00e8 abusivo e quindi \u00e8 prevista una sanzione, cio\u00e8 il risarcimento del danno e anche la nullit\u00e0 del licenziamento.<\/span><\/span><\/p>\n<p><em><a href=\"https:\/\/gregorydamy.niceavocats.fr\/\"><span>Studio Legale DAMY<\/span><\/a><span>\u00a0, Nizza, Diritto del Lavoro-Incapacit\u00e0, Aggiornamento 2016<\/span><\/em><\/p>\n<p><a href=\"https:\/\/www.legifrance.gouv.fr\/\"><span>Francia legale<\/span><\/a><\/p>\n<\/div>\n<\/div>\n<\/div>\n<p>[\/et_pb_text][\/et_pb_column][\/et_pb_row][et_pb_row _builder_version=&#8221;4.19.5&#8243;
