In un momento in cui Google ha elencato\u00a0\u00a0<\/span><\/span>gran\u00a0<\/span><\/span>\u00a0parte della Francia nel suo famoso Google Maps, pu\u00f2 capitare di trovarci per caso su una di queste\u00a0\u00a0<\/span><\/span>fotografie\u00a0<\/span><\/span>\u00a0.\u00a0<\/span><\/span>\u00c8 permesso?\u00a0Posso richiedere la rimozione di questa foto e come?<\/span><\/p>\n

\u00c8 legale?<\/span><\/h2>\n

L’uso della tua fotografia richiede il tuo previo consenso.\u00a0Questo uso \u00e8 limitato a un uso preciso da te definito e hai la possibilit\u00e0 in qualsiasi momento di rimuovere la foto.\u00a0\u00c8 il caso, ad esempio, delle foto postate sul \u201ctrombinoscopio\u201d di un’azienda o su un social network.<\/span>
In pratica Google quindi non ha alcun interesse a inserire la tua foto su Google Maps perch\u00e9 sarebbe troppo complicato chiedere il consenso a tutte le persone fotografate.\u00a0Per rimanere all’interno del quadro legale, Google Maps utilizza quindi un processo di sfocatura facciale.La difficolt\u00e0 sta nel fatto che questo processo non \u00e8 affidabile al 100%: alcune persone potrebbero, infatti, essere riconoscibili per il loro aspetto generale, oppure perch\u00e9 si trovano davanti alla propria abitazione e, quindi, si rischia di superare il quadro giuridico per l’uso di queste fotografie.\u00a0\u00c8 il caso di un uomo che, dopo essere stato fotografato mentre urinava nel suo giardino, \u00e8 stato riconosciuto da tutto il suo villaggio.<\/span><\/p>\n

Come posso cancellare la mia foto?<\/span><\/h2>\n

La\u00a0<\/span>legge \u201cInformatique et Libert\u00e9s\u201d<\/span><\/a>\u00a0\u00bb ti consente di avere accesso o di richiedere la cancellazione o la rettifica dei tuoi dati personali.\u00a0Si applica anche alle fotografie, poich\u00e9 una fotografia costituisce un dato personale.\u00a0Quindi, puoi contattare Google per chiedere loro di sfocare o rimuovere la tua foto.\u00a0Inoltre, Google ha messo a disposizione degli utenti uno strumento di segnalazione, sotto forma di scheda in fondo a ogni pagina: permette di richiedere non solo l’offuscamento o la rimozione della propria foto, ma anche l’offuscamento della propria abitazione, del proprio veicolo, targa, ecc. o la rimozione di qualsiasi altro contenuto illegale.\u00a0Google \u00e8 tenuta a farlo entro breve tempo e la Commissione nazionale per l’informatica e le libert\u00e0 (CNIL) \u00e8 particolarmente vigile al riguardo.Se l’eliminazione o la sfocatura di una foto non viene eseguita rapidamente, puoi sempre contattare il CNIL, che eseguir\u00e0 la due diligence con Google.\u00a0<\/span>Come ultima risorsa, puoi anche andare in tribunale, ma la procedura richieder\u00e0 pi\u00f9 tempo.<\/span>
