TRASCURABILI<\/span><\/h2>\n<p><a href=\"https:\/\/travail-emploi.gouv.fr\/droit-du-travail\/lutte-contre-le-travail-illegal-10802\/article\/les-sanctions-liees-au-travail-illegal\"><span>I rischi per un datore di lavoro che non dichiara il proprio dipendente<\/span><\/a><span>\u00a0sono davvero notevoli e le condanne sono comuni.\u00a0Anche se inizialmente il lavoratore accetta di non farsi dichiarare, ci\u00f2 non gli impedisce, in seguito, di attaccare il suo datore di lavoro.<\/span><\/p>\n<h2><span>POSSO ATTACCARE I PRUD&#8217;HOMMES?<\/span><\/h2>\n<p><span>Uno dei rischi maggiori \u00e8 vedere il tuo dipendente agire dinanzi al tribunale del lavoro.\u00a0Per fare ci\u00f2 ha a disposizione un termine di cinque anni dalla cessazione del rapporto di lavoro.\u00a0Nella maggior parte dei casi, il datore di lavoro \u00e8 condannato al risarcimento dei danni subiti, a cui si aggiunge il risarcimento previsto dal codice del lavoro pari a sei mesi di stipendio.<\/span><\/p>\n<h2><span>POSSO ESSERE ATTACATO CRIMINALMENTE?<\/span><\/h2>\n<p><span>Il datore di lavoro pu\u00f2 essere giudicato anche dal tribunale penale.\u00a0Secondo il codice del lavoro rischia fino a \u201c3 anni di reclusione e una multa di 45.000 euro\u201d.\u00a0In caso di recidiva le sanzioni sono raddoppiate.<\/span><\/p>\n<h2><span>DOVR\u00d2 RIMBORSARE LE TASSE NON PAGATE?<\/span><\/h2>\n<p><span>Il datore di lavoro dovr\u00e0 rimborsare in tre anni tutti i contributi previdenziali, tasse e imposte con maggiorazione e sanzioni per ritardato pagamento.<\/span><\/p>\n<h2><span>COSA SUCCEDE IN CASO DI INFORTUNIO SUL LAVORO?<\/span><\/h2>\n<p><span>Il datore di lavoro \u00e8 considerato responsabile in caso di infortunio sul lavoro del dipendente non dichiarato.\u00a0Dovr\u00e0 pagare una multa, rimborsare le spese mediche, pagare i danni e, se prevista, una pensione di invalidit\u00e0.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><a
