sticky_enabled=&#8221;0&#8243;]<\/p>\n<div class=\"entry-content\">\n<h2><span><span class=\"\">Salvo abusi, il lavoratore gode della libert\u00e0 di espressione all&#8217;interno e all&#8217;esterno dell&#8217;azienda, alla quale possono essere apportate solo restrizioni giustificate dalla natura dell&#8217;incarico da svolgere e proporzionate allo scopo desiderato.<\/span><\/span><\/h2>\n<p><span>Un dirigente, membro del comitato di gestione, aveva creato un sindacato e distribuito, a nome di questo sindacato, un volantino in cui denunciava &#8220;l&#8217;ansia, lo stress, la sfiducia e le incertezze di tutti, di fronte alle voci e alle altre ristrutturazioni che sono allo stesso tempo subdolo e rischioso\u201d.\u00a0Dopo un temporaneo licenziamento, \u00e8 stato licenziato.<\/span><\/p>\n<p><span>La Corte di Cassazione, censurando la decisione dei giudici di merito, ritiene che quanto affermato nel volantino non costituisse un abuso della libert\u00e0\u00a0<\/span><a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/section_lc\/LEGITEXT000006072050\/LEGISCTA000006160738\/\"><span>di espressione<\/span><\/a><span>\u00a0da parte del dipendente.\u00a0Ricorda che alla libert\u00e0 di espressione dei dipendenti possono essere imposte solo restrizioni giustificate dalla natura della mansione da svolgere e proporzionate allo scopo perseguito.<\/span><\/p>\n<p><span><span class=\"VIpgJd-yAWNEb-VIpgJd-fmcmS-sn54Q\">Inoltre, per la High Court, le osservazioni non erano n\u00e9 offensive, n\u00e9 diffamatorie, n\u00e9 eccessive e il fatto che provenissero da un membro del comitato di gestione non doveva essere preso in considerazione.<\/span><\/span><\/p>\n<p><span>Avvocato\u00a0<\/span><a href=\"https:\/\/gregorydamy.niceavocats.fr\/\"><span>Gr\u00e9gory DAMY<\/span><\/a><span>\u00a0Bel diritto del lavoro, libert\u00e0 di espressione<\/span><\/p>\n<\/div>\n<p>[\/et_pb_text][\/et_pb_column][\/et_pb_row][et_pb_row _builder_version=&#8221;4.19.5&#8243;
