hover_enabled=&#8221;0&#8243; global_colors_info=&#8221;{}&#8221; sticky_enabled=&#8221;0&#8243;]<\/p>\n<h2><span><span class=\"\">Un viaggio all&#8217;estero pu\u00f2 rientrare nell&#8217;attivit\u00e0 abituale del dipendente e pertanto non rientra nell&#8217;applicazione di una clausola di mobilit\u00e0.<\/span><\/span><\/h2>\n<p><span>Un dipendente di un&#8217;azienda internazionale viene licenziato per colpa grave per aver rifiutato un viaggio all&#8217;estero per una riunione.\u00a0Il datore di lavoro si \u00e8 basato sul contratto di lavoro dell&#8217;interessato, che prevedeva che questi potesse essere chiamato a svolgere incarichi all&#8217;estero, e ha riconosciuto che la mobilit\u00e0 del dipendente nell&#8217;esercizio delle sue funzioni costituiva una condizione sostanziale del CONTRATTO.<\/span><br \/><span>Per i giudici del processo la clausola contrattuale doveva essere analizzata come\u00a0<\/span><a href=\"https:\/\/www.service-public.fr\/particuliers\/vosdroits\/F31576\"><span>una clausola di mobilit\u00e0<\/span><\/a><span>\u00a0e, poich\u00e9 non fissava un limite geografico, tale clausola di mobilit\u00e0 era nulla.\u00a0Anche la risoluzione del contratto doveva essere analizzata come un licenziamento senza reale e grave causa.<\/span><br \/><span>La Corte di Cassazione non approva tale decisione: per essa, la semplice constatazione che il viaggio rifiutato dal dipendente rientrava nell&#8217;ambito abituale della sua attivit\u00e0 di consulente internazionale era sufficiente a giustificare la decisione del datore di lavoro.\u00a0Non era necessario in questo caso verificare se la clausola del contratto fosse valida o meno.<\/span><\/p>\n<p><span>Avvocato\u00a0<\/span><a href=\"https:\/\/gregorydamy.niceavocats.fr\/\"><span>Gr\u00e9gory DAMY<\/span><\/a><span>\u00a02022 Bel diritto del lavoro<\/span><\/p>\n<p>&nbsp;<\/p>\n<p>[\/et_pb_text][\/et_pb_column][\/et_pb_row][et_pb_row _builder_version=&#8221;4.19.5&#8243;
