Soc., 20 de noviembre de 1991, n\u00ba 88-43.120).<\/p>\n<p style=\"text-align: justify;\">Se considera que una prueba es il\u00edcita o injusta cuando se ha obtenido mediante un procedimiento ilegal o sin el conocimiento de la persona.<\/p>\n<p style=\"text-align: justify;\">Es el caso, por ejemplo, de la grabaci\u00f3n de una conversaci\u00f3n telef\u00f3nica sin conocimiento del interlocutor (Cass. Com., 3 de junio de 2008, n\u00ba 07-17.147, n\u00ba 07-17.196).<\/p>\n<p style=\"text-align: justify;\">O la realizaci\u00f3n de grabaciones audiovisuales mediante c\u00e1maras de vigilancia colocadas sin conocimiento de los empleados (Cass. Soc. 19 de abril de 2005, n\u00ba 02-46.295).<\/p>\n<p style=\"text-align: justify;\">Sin embargo, a veces las pruebas il\u00edcitas o injustamente obtenidas son el \u00fanico medio de prueba que permite al trabajador hacer valer sus derechos.<\/p>\n<p style=\"text-align: justify;\">En el caso que nos ocupa, en la sentencia de 22 de diciembre de 2023, un trabajador hab\u00eda transcrito una reuni\u00f3n con su empresario que hab\u00eda sido grabada sin su conocimiento.<\/p>\n<p style=\"text-align: justify;\">De conformidad con la jurisprudencia vigente, los jueces del Tribunal de Apelaci\u00f3n excluyeron esta prueba del procedimiento, por considerarla injusta y, por tanto, inadmisible.<\/p>\n<p style=\"text-align: justify;\">Sin embargo, el Tribunal de Casaci\u00f3n decidi\u00f3 revocar esta decisi\u00f3n, declarando inadmisibles las pruebas aportadas por el empleado.<\/p>\n<p style=\"text-align: justify;\">Seg\u00fan los jueces, las pruebas obtenidas ilegal o injustamente ya no deben rechazarse sistem\u00e1ticamente, sino que deben someterse a una prueba de proporcionalidad entre el derecho a la prueba y el derecho afectado por dicha prueba.<\/p>\n<p style=\"text-align: justify;\">En otras palabras, los jueces tendr\u00e1n que llevar a cabo un aut\u00e9ntico examen in concreto para determinar si el derecho a la prueba debe prevalecer sobre otro derecho.<\/p>\n<p style=\"text-align: justify;\">Se trata de un cambio fundamental en la jurisprudencia en este \u00e1mbito.<\/p>\n<p style=\"text-align: justify;\">Ma\u00eetre DAMY, abogado en Niza y experto en derecho laboral, le acompa\u00f1ar\u00e1 a lo largo de todo el procedimiento laboral.<\/p>\n<p>[\/et_pb_text][\/et_pb_column][\/et_pb_row][\/et_pb_section]<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Nice labour law lawyer &#8211; La prueba en derecho del trabajo.
