V, n.\u00b0 209).<\/p>\n<p>El impago de salarios, la falta de suministro de trabajo, la inobservancia de las normas de seguridad, el incumplimiento del descanso semanal, son, a modo de ejemplo, todas las conductas graves del empleador que pueden justificar la adopci\u00f3n de medidas del empleado<\/p>\n<p>Un concepto pretoriano, la toma de un acto ha entrado recientemente en el C\u00f3digo del Trabajo gracias a la Ley No. 2014-743 del 1 de julio de 2014.<\/p>\n<p>Este texto establece un procedimiento acelerado para las solicitudes de calificaci\u00f3n de actos presentadas por el trabajador por dos motivos:<\/p>\n<p>&#8211; por un lado, el litigio se presenta directamente ante la oficina judicial, sin fase de conciliaci\u00f3n<br \/>&#8211; por otra parte, el Consejo dispone de un plazo de un mes para examinar la solicitud<\/p>\n<p>La rapidez est\u00e1 tanto m\u00e1s justificada cuanto que el trabajador que ha tomado nota de la rescisi\u00f3n de su contrato de trabajo no es indemnizado por el seguro de desempleo en espera de la decisi\u00f3n del tribunal laboral.<\/p>\n<p>Tribunal de Casaci\u00f3n, en lo civil, Sala de lo Social, 26 de marzo de 2014, Sin embargo, esta tramitaci\u00f3n acelerada de solicitudes no debe incentivar a los trabajadores a rescindir su contrato ante cualquier conducta defectuosa por parte de su empleador.<\/p>\n<p>La Sala de lo Social del Tribunal de Casaci\u00f3n aclar\u00f3 recientemente que los incumplimientos de los que se acusa al empleador deben ser lo suficientemente graves como para impedir la continuaci\u00f3n del contrato de trabajo (Cass. soc., 26 de marzo de 2014, n\u00b012-23.634; Cass. soc., 26 de marzo de 2014, N\u00b0 12-35.040; Cass. soc., 26 de marzo de 2014, N\u00b0 12-21.372).<\/p>\n<p>As\u00ed, tanto la gravedad de las faltas del empresario como el tiempo transcurrido entre su comisi\u00f3n y la interposici\u00f3n de una acci\u00f3n condicionan la calificaci\u00f3n de la interposici\u00f3n de una acci\u00f3n como despido sin causa real y grave.<\/p>\n<p>Al igual que las faltas graves que justifican el despido, las deficiencias del empleador deben, por tanto, ser intolerables, imposibilitando el mantenimiento de la relaci\u00f3n laboral.<\/p>\n<p>Queda por ver si el objetivo de velocidad apuntado por el legislador ser\u00e1 alcanzable en la pr\u00e1ctica, dada la congesti\u00f3n de los tribunales laborales.<\/p>\n<p>{jcomentarios sobre}<\/p>\n<p>[\/et_pb_text][\/et_pb_column][\/et_pb_row][et_pb_row _builder_version=&#8221;4.19.5&#8243; _module_preset=&#8221;default&#8221; custom_margin=&#8221;||0px||false|false&#8221; custom_padding=&#8221;||0px||false|false&#8221; global_colors_info=&#8221;{}&#8221; theme_builder_area=&#8221;post_content&#8221;][et_pb_column type=&#8221;4_4&#8243; _builder_version=&#8221;4.19.5&#8243; _module_preset=&#8221;default&#8221; global_colors_info=&#8221;{}&#8221; theme_builder_area=&#8221;post_content&#8221;][et_pb_divider _builder_version=&#8221;4.19.5&#8243; _module_preset=&#8221;default&#8221; global_colors_info=&#8221;{}&#8221; theme_builder_area=&#8221;post_content&#8221;][\/et_pb_divider][\/et_pb_column][\/et_pb_row][\/et_pb_section]<\/p>\n","protected":false},"excerpt":{"rendered":"<p>El trabajador podr\u00e1 tomar nota de la extinci\u00f3n de su contrato de trabajo por incumplimiento de sus obligaciones esenciales por parte del empleador.
