la incapacidad f\u00edsica o mental del empleado para realizar la tarea que le ha sido encomendada.\u00a0Esta incapacidad puede tener un origen profesional (accidente profesional) o resultar de la vida cotidiana (gripe, etc.).\u00a0Lo constata el m\u00e9dico del trabajo que toma su decisi\u00f3n tras examinar el puesto seg\u00fan un procedimiento bien definido con dos entrevistas diferentes.\u00a0La decisi\u00f3n final se puede apelar ante la inspecci\u00f3n del trabajo, que a su vez puede recurrirse ante el tribunal administrativo.\u00a0En ning\u00fan caso el propio empleador podr\u00e1 determinar la incapacidad de un trabajador.<\/span><\/p>\n<h2><span>\u00bfQu\u00e9 hacer si un empleado es declarado incapacitado?<\/span><\/h2>\n<p>&nbsp;<\/p>\n<p><span>La empresa deber\u00e1 buscar una reclasificaci\u00f3n en la empresa o en el grupo, y encontrar un puesto de trabajo compatible con el estado del empleado consultando al m\u00e9dico del trabajo que tiene la obligaci\u00f3n de dar recomendaciones.\u00a0Si el empleado no es apto, deber\u00e1 ser despedido en un plazo razonable.\u00a0Si durante m\u00e1s de un mes no se ha iniciado ning\u00fan procedimiento de despido, deber\u00e1 reanudarse el pago del salario si \u00e9ste hubiera sido suspendido.<\/span><\/p>\n<h2><span>\u00bfCu\u00e1nto cuesta un despido por incapacidad?<\/span><\/h2>\n<p>&nbsp;<\/p>\n<p><span>El coste var\u00eda dependiendo de si\u00a0<\/span><a href=\"https:\/\/travail-emploi.gouv.fr\/emploi-et-insertion\/emploi-et-handicap\/rqth#:~:text=En%20cas%20de%20licenciement%2C%20la,mois%20la%20dur%C3%A9e%20du%20pr%C3%A9avis.\"><span>la incapacidad<\/span><\/a><span>\u00a0est\u00e1 relacionada con el trabajo o no.\u00a0Si se trata de un accidente de trabajo, la ley establece que se duplica la indemnizaci\u00f3n de despido y que se vierte el aviso.\u00a0Si no es de origen profesional, se aplica la regla habitual: se paga una indemnizaci\u00f3n por despido, y no hay indemnizaci\u00f3n por despido ya que el empleado no puede trabajar durante su preaviso.<\/span><br \/><span>Si el empleador no pretende reclasificar a su empleado, el despido es abusivo y por tanto existe una sanci\u00f3n, concretamente una
