El art\u00edculo demuestra que la negociaci\u00f3n empresarial es la forma de operar una regulaci\u00f3n legal descentralizada a nivel empresarial.\u00a0En muchas reestructuraciones, las empresas encuentran soluciones a trav\u00e9s de acuerdos sociales sobre el empleo.\u00a0Estos \u00faltimos destacan una descentralizaci\u00f3n de la ley.\u00a0Permiten una adaptaci\u00f3n, una creaci\u00f3n de normas correspondientes a las necesidades espec\u00edficas del operador econ\u00f3mico.\u00a0Esta negociaci\u00f3n empresarial es incluso un instrumento para el desarrollo y modificaci\u00f3n del derecho nacional.<\/span><\/p>\n

El trabajo realizado tiende a confirmar que la idea misma de una jerarqu\u00eda de normas est\u00e1 indudablemente, si no obsoleta, al menos atrapada en enredos m\u00e1s complejos.\u00a0El sistema piramidal tradicional parece ser sustituido por un sistema circular que tiende no a oponerse ni a excluir, sino m\u00e1s bien a conciliar reglas de diferentes or\u00edgenes que se retroalimentan.\u00a0Ahora se trata menos de supremac\u00eda e inferioridad que de interacci\u00f3n y combinaci\u00f3n de fuentes.<\/span>
Estas diversas fuentes sirven a diferentes intereses y contribuyen a la formaci\u00f3n de una nueva ley, adaptada a las especificidades y limitaciones del mercado.<\/span><\/p>\n

Desde el 24\/09\/2017 las ordenanzas Macron han generado nuevas reglas aplicables a las negociaciones comerciales dej\u00e1ndoles mucha m\u00e1s libertad pero tambi\u00e9n obligaciones.\u00a0En efecto, salvo disposiciones de orden p\u00fablico, los empresarios pueden negociar m\u00e1s libremente con los trabajadores pero tambi\u00e9n tienen la obligaci\u00f3n de hacerlo al menos cada cuatro a\u00f1os.<\/span><\/p>\n
