background_repeat=&#8221;repeat&#8221; hover_enabled=&#8221;0&#8243; global_colors_info=&#8221;{}&#8221; sticky_enabled=&#8221;0&#8243;]<\/p>\n<div class=\"entry-content\">\n<p><span>El papel de un\u00a0<\/span><a href=\"https:\/\/gregorydamy.niceavocats.fr\/en\/moral-harassment-criteria\/\"><span>representante<\/span><\/a><span>\u00a0del personal es defender los\u00a0<\/span><a href=\"https:\/\/www.legifrance.gouv.fr\/\"><span>intereses<\/span><\/a><span>\u00a0de los empleados dentro de una empresa.\u00a0<span class=\"\">Elegido cada cuatro a\u00f1os, su principal misi\u00f3n es presentar a los empleadores todas las denuncias individuales o colectivas.<\/span><\/span><\/p>\n<h2><span>Sus misiones:<\/span><\/h2>\n<p><span>Como representante de los trabajadores de una empresa, la misi\u00f3n del representante del personal es informar al empleador de todas las quejas individuales o colectivas.\u00a0Tambi\u00e9n asiste al empleado durante las entrevistas.\u00a0El representante del personal puede ponerse en contacto con la inspecci\u00f3n del trabajo en caso de incumplimiento del c\u00f3digo laboral o del convenio colectivo, y tambi\u00e9n verifica el cumplimiento de los salarios y la correcta aplicaci\u00f3n de las normas de salud y seguridad.<\/span><\/p>\n<h2><span>Su elecci\u00f3n:<\/span><\/h2>\n<p><span>La elecci\u00f3n de los representantes del personal tiene lugar cada cuatro a\u00f1os y es obligatoria en cualquier estructura que emplee al menos 11 empleados durante 12 meses.\u00a0Si el empleador no organiza espont\u00e1neamente estas elecciones, podr\u00e1n ser solicitadas por cualquier empleado o por cualquier organizaci\u00f3n sindical.\u00a0Para ser elegible, debe tener 18 a\u00f1os y tener una antig\u00fcedad de un a\u00f1o.\u00a0Es una votaci\u00f3n de lista en dos vueltas para cada colegio (obreros y empleados por un lado, t\u00e9cnicos y ejecutivos por otro), con una asignaci\u00f3n de esca\u00f1os por representaci\u00f3n proporcional.<\/span><\/p>\n<h2><span>Sus medios de acci\u00f3n:<\/span><\/h2>\n<p><span>El empleador debe proporcionar al representante del personal la informaci\u00f3n necesaria sobre la empresa: convenio colectivo, reglamento interno, registro de personal, etc. El representante del personal puede ayudar al empleado durante las entrevistas con el empleador, en particular las entrevistas preliminares.\u00a0por un posible castigo.\u00a0Tambi\u00e9n puede reunirse con los empleados.\u00a0Adem\u00e1s, tiene derecho a distribuir folletos y cuenta con un tabl\u00f3n de anuncios.<\/span><\/p>\n<h2><span>Su organizaci\u00f3n:<\/span><\/h2>\n<p><span>El representante del personal conserva sus funciones en la empresa.\u00a0El empleador est\u00e1 obligado a darle el tiempo necesario para el desempe\u00f1o de sus funciones.\u00a0El n\u00famero de horas de delegaci\u00f3n se fija en funci\u00f3n de la plantilla de la empresa.\u00a0Durante este horario de delegaci\u00f3n, podr\u00e1 recibir a los trabajadores en la sala que el empleador le haya puesto a su disposici\u00f3n o acudir al encuentro del personal en su lugar de trabajo.\u00a0Tambi\u00e9n puede dejar la empresa para buscar informaci\u00f3n de una organizaci\u00f3n o sindicato.<\/span><\/p>\n<h2><span>Su estado protegido:<\/span><\/h2>\n<p><span>Para evitar sanciones por su cargo, el representante del personal est\u00e1 protegido mientras dure su misi\u00f3n.\u00a0No se le podr\u00e1 imponer ninguna sanci\u00f3n sin la autorizaci\u00f3n de la inspecci\u00f3n del trabajo.\u00a0Esta protecci\u00f3n contin\u00faa seis meses despu\u00e9s del t\u00e9rmino de sus funciones como delegado.<\/span><\/p>\n<p><span>Bufete de abogados DAMY, Niza, actualizaci\u00f3n 2022<\/span><\/p>\n<\/div>\n<p>[\/et_pb_text][\/et_pb_column][\/et_pb_row][et_pb_row _builder_version=&#8221;4.19.5&#8243;
