hover_enabled=&#8221;0&#8243; global_colors_info=&#8221;{}&#8221; sticky_enabled=&#8221;0&#8243;]<\/p>\n<div class=\"entry-content\">\n<p><a href=\"https:\/\/gregorydamy.niceavocats.fr\/en\/multiple-employment\/\"><span class=\"\">Un contrato<\/span><\/a><span class=\"\">\u00a0de duraci\u00f3n determinada es un\u00a0<\/span><a href=\"https:\/\/www.justice.fr\/\"><span class=\"\">contrato<\/span><\/a><span class=\"\">\u00a0precario\u00a0<\/span><span class=\"\">, pero el empleado se beneficia en principio de los mismos derechos que un empleado con un contrato indefinido por salario, vacaciones pagadas o formaci\u00f3n.\u00a0<\/span>Tambi\u00e9n existen otras particularidades propias del CDD.<\/p>\n<h2>EL SALARIO<\/h2>\n<p>Existe un principio de igualdad con un trabajador con contrato indefinido si la formaci\u00f3n y funciones son equivalentes.\u00a0Esto es a\u00fan m\u00e1s cierto cuando se trata de un CDD de reemplazo.\u00a0La comparaci\u00f3n es muy clara entre el salario del empleado reemplazado y el del reemplazante.\u00a0Pero el salario puede ser menor si el empleado que se sustituye tiene una larga antig\u00fcedad en la empresa.<\/p>\n<h2>EL PER\u00cdODO DE PRUEBA<\/h2>\n<p>El contrato de duraci\u00f3n determinada puede incluir un per\u00edodo de prueba, pero no es obligatorio.\u00a0Si la duraci\u00f3n del contrato es inferior a 6 meses, el per\u00edodo de prueba ser\u00e1 de un d\u00eda por semana trabajada.\u00a0Por ejemplo, para un contrato de un mes, ser\u00e1 un m\u00e1ximo de 4 d\u00edas.\u00a0Si el contrato dura m\u00e1s de 6 meses, el per\u00edodo de prueba no puede ser superior a un mes.\u00a0Es raro que el contrato se rescinda durante el per\u00edodo de prueba.<\/p>\n<h2>VACACIONES PAGADAS<\/h2>\n<p>El trabajador tiene los mismos derechos que el trabajador con contrato indefinido, es decir, 2,5 d\u00edas de vacaciones al mes.\u00a0Si el trabajador no pudo tomar su licencia durante su contrato, se le pagar\u00e1 al final.<\/p>\n<h2>CAPACITACI\u00d3N<\/h2>\n<p>Un empleado con contrato de duraci\u00f3n determinada tiene la opci\u00f3n de solicitar formaci\u00f3n, incluyendo el permiso de formaci\u00f3n individual.\u00a0Tiene que esperar 4 meses antes de aplicar.\u00a0Solo que, en la pr\u00e1ctica, es raro que un empleado se beneficie de la formaci\u00f3n porque la brevedad del contrato muchas veces no lo permite.<\/p>\n<h2>INCUMPLIMIENTO DE CONTRATO<\/h2>\n<p>El CDD debe ser completado.\u00a0El empleado se beneficia de cierta protecci\u00f3n.\u00a0El empleador no puede romper el contrato sin una raz\u00f3n importante.\u00a0Esto solo es posible en caso de falta grave o si ambas partes acuerdan rescindir el contrato.\u00a0El trabajador tambi\u00e9n puede rescindirlo si encuentra un contrato de duraci\u00f3n indefinida.<\/p>\n<h2>INDEMNIZACIONES<\/h2>\n<p>Al t\u00e9rmino del contrato, el trabajador tiene derecho a una indemnizaci\u00f3n por t\u00e9rmino de contrato que generalmente es del 10% del salario percibido debido a que el CDD es un contrato precario.\u00a0Si el empleador ofrece al empleado un CDI despu\u00e9s de la CDD y el empleado se niega, pierde sus asignaciones.\u00a0Tampoco se beneficia si rompe su actual contrato de CDI en otra empresa.<\/p>\n<p>Soci\u00e9t\u00e9 d&#8217;Avocats DAMY, abogado de derecho laboral en Niza, CDD, Actualizaci\u00f3n 2016.<\/p>\n<\/div>\n<p>[\/et_pb_text][\/et_pb_column][\/et_pb_row][et_pb_row _builder_version=&#8221;4.19.5&#8243;
