DESCUIDABLES<\/span><\/h2>\n<p><a href=\"https:\/\/travail-emploi.gouv.fr\/droit-du-travail\/lutte-contre-le-travail-illegal-10802\/article\/les-sanctions-liees-au-travail-illegal\"><span>Los riesgos para un empresario que no declara a su empleado<\/span><\/a><span>\u00a0son realmente importantes y las condenas son habituales.\u00a0Incluso si, inicialmente, el empleado acepta no ser declarado, esto no le impide, posteriormente, atacar a su empleador.<\/span><\/p>\n<h2><span>\u00bfPUEDO ATACAR A LOS PRUD&#8217;HOMMES?<\/span><\/h2>\n<p><span>Uno de los principales riesgos es que su empleado act\u00fae ante el tribunal laboral.\u00a0Para ello dispone de un plazo de cinco a\u00f1os desde la finalizaci\u00f3n de la relaci\u00f3n laboral.\u00a0La mayor\u00eda de las veces, se condena al empleador a pagar una indemnizaci\u00f3n por el da\u00f1o sufrido, a lo que se suma la indemnizaci\u00f3n prevista por el C\u00f3digo del Trabajo, que asciende a seis meses de salario.<\/span><\/p>\n<h2><span>\u00bfPUEDO SER ATACADO CRIMINALMENTE?<\/span><\/h2>\n<p><span>El empleador tambi\u00e9n puede ser juzgado por el tribunal penal.\u00a0Seg\u00fan el C\u00f3digo del Trabajo, se enfrenta a &#8220;tres a\u00f1os de prisi\u00f3n y una multa de 45.000 euros&#8221;.\u00a0En caso de reincidencia, las penas se duplican.<\/span><\/p>\n<h2><span>\u00bfTENDR\u00c9 QUE REEMBOLSAR LOS IMPUESTOS NO PAGADOS?<\/span><\/h2>\n<p><span>El empleador deber\u00e1 reembolsar todas las cotizaciones a la seguridad social, impuestos y derechos durante tres a\u00f1os, con un trabajo no declarado de un empleado.\u00a0Tendr\u00e1 que pagar una multa, reembolsar gastos m\u00e9dicos, pagar da\u00f1os y perjuicios y, en su caso, una pensi\u00f3n de
