background_repeat=&#8221;repeat&#8221; hover_enabled=&#8221;0&#8243; global_colors_info=&#8221;{}&#8221; sticky_enabled=&#8221;0&#8243;]<\/p>\n<div class=\"entry-content\">\n<p><span class=\"\"><span>Contrariamente\u00a0<\/span><\/span><span class=\"\"><span>\u00a0a la creencia popular, un funcionario\u00a0\u00a0<\/span><\/span><span class=\"\"><span>puede\u00a0<\/span><\/span><span class=\"\"><span>\u00a0ser despedido.\u00a0<\/span><\/span><span>Pero los motivos de despido, indemnizaci\u00f3n y recurso difieren.<\/span><\/p>\n<h2><span>ESTADO PROTEGIDO.<\/span><\/h2>\n<p><span>Los funcionarios se benefician de una mayor seguridad laboral debido a dos grandes diferencias con el resto de empleados: no hay despido econ\u00f3mico ya que en caso de p\u00e9rdida del empleo hay reclasificaci\u00f3n o despido.\u00a0Y ning\u00fan despido por mala conducta;\u00a0en caso de conducta reprobable, hablamos de revocaci\u00f3n.\u00a0Se trata de una medida disciplinaria grave y rara que pone fin a la carrera de un funcionario sin indemnizaci\u00f3n por despido ni compensaci\u00f3n por desempleo.<\/span><\/p>\n<h2><span>CASO DE TERMINACI\u00d3N.<\/span><\/h2>\n<p><span>En caso de insuficiencia profesional, es decir, cuando el trabajo ya no es satisfactorio y el consejo disciplinario emite un dictamen favorable, un funcionario puede ser despedido.\u00a0La incapacidad f\u00edsica tambi\u00e9n es motivo de despido si la comisi\u00f3n m\u00e9dica considera que el estado de salud del funcionario es incompatible con el ejercicio de su carrera.\u00a0Finalmente, cuando un funcionario, despedido o en baja parental, rechaza tres puestos, podr\u00e1 ser despedido por falta de posibilidad de reintegro.<\/span><\/p>\n<h2><span>BENEFICIOS DE DESEMPLEADO.<\/span><\/h2>\n<p><span>En caso de\u00a0<\/span><a href=\"https:\/\/www.service-public.fr\/particuliers\/vosdroits\/F514\"><span>despido<\/span><\/a><span>\u00a0, el funcionario tiene derecho a prestaciones por desempleo.\u00a0El c\u00e1lculo de la indemnizaci\u00f3n tiene en cuenta el salario bruto y la remuneraci\u00f3n percibida por el funcionario.<\/span><\/p>\n<h2><span>POSIBLES REMEDIOS.<\/span><\/h2>\n<p><span>A diferencia de un empleado del sector privado, el funcionario no puede impugnar su despido ante el tribunal laboral sino ante el tribunal administrativo.\u00a0<\/span><span class=\"\"><span>Un funcionario s\u00f3lo dispone de 2 meses para impugnar su despido, frente a los 5 a\u00f1os de un empleado del sector privado.\u00a0<\/span><\/span><span class=\"\"><span>El servidor p\u00fablico podr\u00e1 solicitar la cancelaci\u00f3n de su despido y su reintegro en sus funciones o solicitar del Estado una indemnizaci\u00f3n por el da\u00f1o sufrido.<\/span><\/span><\/p>\n<p><a href=\"https:\/\/gregorydamy.niceavocats.fr\/\"><span>Bufete de abogados DAMY<\/span><\/a><span>\u00a0, Niza, Funcionario y despido, Actualizado 2022<\/span><\/p>\n<\/div>\n<p>[\/et_pb_text][\/et_pb_column][\/et_pb_row][et_pb_row _builder_version=&#8221;4.19.5&#8243;
