background_repeat=&#8221;repeat&#8221; hover_enabled=&#8221;0&#8243; global_colors_info=&#8221;{}&#8221; sticky_enabled=&#8221;0&#8243;]<\/p>\n<div class=\"entry-content\">\n<p><span>Ni despido ni renuncia, el despido convencional\u00a0<\/span><span>\u00a0es el resultado de la negociaci\u00f3n entre empresario y trabajador.\u00a0<\/span><span class=\"\"><span>Un ejercicio muy particular y\u00a0\u00a0<\/span><\/span><span class=\"\"><span>a veces\u00a0<\/span><\/span><span class=\"\"><span>\u00a0delicado.<\/span><\/span><\/p>\n<h2><span>NO TOMES LA INICIATIVA.<\/span><\/h2>\n<p><span>El procedimiento\u00a0<\/span><a href=\"https:\/\/www.service-public.fr\/particuliers\/vosdroits\/F19030\"><span>de rescisi\u00f3n convencional<\/span><\/a><span>\u00a0es muy informal.\u00a0Muchas veces es el empleador quien toma la iniciativa en la negociaci\u00f3n y lo hace verbalmente.<\/span><br \/><span>Tampoco se recomienda que los empleados tomen la iniciativa porque ciertos empleadores pueden utilizarla en su contra ante el tribunal laboral cuando desean despedirlos.<\/span><\/p>\n<h2><span>NEGOCIAR PAGOS POR TERMINACI\u00d3N.<\/span><\/h2>\n<p><span>La ley establece un m\u00ednimo igual al monto de la indemnizaci\u00f3n convencional en caso de convenio colectivo, o al monto de la indemnizaci\u00f3n legal en caso de que no exista convenio colectivo.<\/span><br \/><span>El empleado puede negociar para obtener una remuneraci\u00f3n convencional m\u00e1s elevada porque se beneficia de un r\u00e9gimen fiscal ventajoso y de hasta dos a\u00f1os de exenci\u00f3n salarial.<\/span><\/p>\n<h2><span>NEGOCIAR BENEFICIOS EN ESPECIE.<\/span><\/h2>\n<p><span>Durante la negociaci\u00f3n, el empleado puede intentar conservar sus prestaciones en especie.\u00a0Puede ser el veh\u00edculo de la empresa, el tel\u00e9fono de la empresa, el ordenador port\u00e1til o incluso el alojamiento de la empresa durante unos meses.\u00a0El empleador tiene derecho a negarse, pero si quiere una marcha r\u00e1pida, el empleado puede esperar conservar uno o dos beneficios.<\/span><\/p>\n<h2><span>NEGOCIAR LA FECHA DE FINALIZACI\u00d3N DEL CONTRATO.<\/span><\/h2>\n<p><span>La fecha de finalizaci\u00f3n del contrato es de al menos 15 d\u00edas despu\u00e9s de la firma del acuerdo.<\/span><br \/><span>El empleado puede tener inter\u00e9s en satisfacer sus necesidades durante un per\u00edodo m\u00e1s largo.\u00a0Por ejemplo, para avisar o beneficiarse del apoyo de P\u00f4le emploi.\u00a0Para beneficiarse de \u00e9l es necesario tener cierta antig\u00fcedad en la empresa.<\/span><\/p>\n<h2><span>POSIBILIDAD DE RETIRAR.<\/span><\/h2>\n<p><span>Tanto el empleado como el empleador pueden retirarse.\u00a0En este caso, deber\u00e1 enviar una carta certificada con acuse de recibo a la otra parte o entregar una carta en mano contra el alta.<\/span><br \/><span>Pero el desistimiento es bastante raro, especialmente por parte del trabajador, ya que puede impugnar la rescisi\u00f3n del contrato ante el tribunal laboral durante un a\u00f1o.<\/span><\/p>\n<h2><span>N\u00d3TESE BIEN:<\/span><\/h2>\n<p><span>Si debe interponerse recurso de apelaci\u00f3n sobre el acuerdo, su aprobaci\u00f3n o su denegaci\u00f3n, deber\u00e1 presentarse ante el tribunal laboral dentro de los 12 meses siguientes a la fecha de aprobaci\u00f3n del acuerdo.<\/span><\/p>\n<p><a href=\"https:\/\/gregorydamy.niceavocats.fr\/\"><span>Bufete de abogados DAMY<\/span><\/a><span>\u00a0, Niza, Terminaci\u00f3n convencional, Actualizado 2022<\/span><\/p>\n<\/div>\n<p>[\/et_pb_text][\/et_pb_column][\/et_pb_row][et_pb_row _builder_version=&#8221;4.19.5&#8243;
