Obligaci\u00f3n de advertencia: responsabilidad del banco por cheques NSF<\/span><\/h2>\n

En banca, los \u00faltimos acontecimientos de 2013\u00a0\u00a0<\/span><\/span>destacan\u00a0<\/span><\/span>\u00a0el importante papel que ha jugado el banco en el pago de cheques por insuficiencia de fondos.\u00a0<\/span><\/span>El banco no puede rechazar un pago \u00fanicamente por fondos insuficientes sin informar al titular de la cuenta de las consecuencias.\u00a0Una sentencia reciente de la Sala Comercial de la Corte de Casaci\u00f3n reafirma esta obligaci\u00f3n de advertencia, enfatizando que la notificaci\u00f3n del banco debe ser enviada antes de que el cheque sea rechazado (Corte de Casaci\u00f3n, Sala Comercial, 7 de febrero de 2012, No. 10-27078).\u00a0La medida refuerza la responsabilidad del banco en el manejo de cheques sin fondos (NSF), particularmente en casos que involucran a comerciantes.<\/span><\/p>\n

Procedimiento de cobro: tramitaci\u00f3n de cheques impagados<\/span><\/h2>\n

Cuando un\u00a0<\/span>banco<\/span><\/a>\u00a0informa que un cheque depositado se devuelve sin pagar por fondos insuficientes, se establece un procedimiento espec\u00edfico para recuperar el monto adeudado.\u00a0Inicialmente, el contacto con el deudor permite considerar una posible soluci\u00f3n amistosa o explorar medios de pago alternativos, como una transferencia o un cheque bancario.\u00a0Si el di\u00e1logo con el emisor del cheque falla y el cheque permanece sin pagar dentro de los 30 d\u00edas de su primera presentaci\u00f3n, tiene dos opciones.\u00a0Una es solicitar al banco del deudor que emita un certificado de falta de pago y la otra es devolver el cheque a la cuenta.\u00a0Ante otro pago fallido, el banco del emisor\u00a0\u00a0<\/span>enviar\u00e1 autom\u00e1ticamente\u00a0<\/span>\u00a0el certificado de falta de pago.<\/span><\/p>\n
