Contratos individuales de trabajo.<\/i><\/p>\n<p><i>1.<\/i> <i>El contrato individual de trabajo se regir\u00e1 por la ley elegida por las partes de conformidad con el art\u00edculo 3.<\/i> <i>No obstante, esta elecci\u00f3n no podr\u00e1 tener como consecuencia que el trabajador se vea privado de la protecci\u00f3n conferida por las disposiciones que no puedan excluirse mediante acuerdo en virtud de la ley que, a falta de elecci\u00f3n, habr\u00eda sido aplicable de conformidad con los apartados 2, 3 y 4 del presente art\u00edculo.<\/i><\/p>\n<p><i>2.<\/i> <i>A falta de elecci\u00f3n por las partes, el contrato individual de trabajo se regir\u00e1 por la ley del pa\u00eds en el que o, en su defecto, desde el que el trabajador, en ejecuci\u00f3n del contrato, realice habitualmente su trabajo.<\/i> <i>No se considerar\u00e1 que cambia el pa\u00eds en el que se realiza habitualmente el trabajo cuando el trabajador realice su trabajo temporalmente en otro pa\u00eds.<\/i><\/p>\n<p><i>3.<\/i> <i>Si la ley aplicable no puede determinarse sobre la base del apartado 2, el contrato se regir\u00e1 por la ley del pa\u00eds en que est\u00e9 situado el establecimiento que haya contratado al trabajador.<\/i><\/p>\n<p><i>4.<\/i> <i>Si del conjunto de las circunstancias se desprende que el contrato presenta v\u00ednculos m\u00e1s estrechos con un pa\u00eds distinto del contemplado en los apartados 2 \u00f3 3, se aplicar\u00e1 la ley de ese otro pa\u00eds.&#8221;<\/i><\/p>\n<p>Este texto abre dos opciones:<\/p>\n<p>&#8211; O bien las partes no se han puesto de acuerdo sobre la legislaci\u00f3n aplicable en el marco del contrato de trabajo de la gente de mar: en este caso, la legislaci\u00f3n laboral aplicable es la del pa\u00eds en el que o desde el que la gente de mar realiza habitualmente su trabajo. Se trata de la legislaci\u00f3n del pa\u00eds del puerto de amarre real del buque.<\/p>\n<p>&#8211; O las partes han acordado la legislaci\u00f3n aplicable en el contrato de trabajo mar\u00edtimo: en este caso, la legislaci\u00f3n laboral aplicable es la del pa\u00eds elegido por las partes.
