Estas razones se derivan principalmente del hecho de que el\u00a0<\/span><\/span><a href=\"https:\/\/gregorydamy.niceavocats.fr\/en\/label-navigation\/\"><span><span class=\"\">la ocupaci\u00f3n<\/span><\/span><\/a><span><span class=\"\">\u00a0del local ya no satisface una necesidad de vivienda.\u00a0<\/span>Adem\u00e1s, el derecho del arrendador a recuperar la posesi\u00f3n del inmueble prevalece sobre el derecho de permanencia del arrendatario.<\/span><\/p>\n<h2><span>El principio de res judicata en casos de recuperaci\u00f3n de arrendamiento<\/span><\/h2>\n<p><span>Una sentencia\u00a0<\/span><a href=\"https:\/\/www.justice.fr\/\"><span>comentada<\/span><\/a><span>\u00a0sirve como recordatorio de que un arrendador, a quien previamente se le ha negado la reposesi\u00f3n con base en el art\u00edculo 19 de la ley, puede iniciar acciones legales con base en el art\u00edculo 10, 9\u00b0, sin que lo impida el principio de cosa juzgada.<\/span><\/p>\n<p><span>En un caso particular, los arrendadores interpusieron una acci\u00f3n de recuperaci\u00f3n de conformidad con sus derechos en virtud del art\u00edculo 19 de la ley de 1 de septiembre de 1948. Sin embargo, su intento no prosper\u00f3.\u00a0Posteriormente, emplaz\u00f3 a los arrendatarios para el desalojo con base en un aviso emitido en los t\u00e9rminos del art\u00edculo 10, 9\u00b0, de la ley.\u00a0El Tribunal de Apelaci\u00f3n de Par\u00eds consider\u00f3 inadmisible su recurso, invocando el principio de cosa juzgada.\u00a0El tribunal razon\u00f3 que los art\u00edculos 10 y 19 ten\u00edan el mismo prop\u00f3sito, que era negar al arrendatario el derecho a permanecer en el local.\u00a0Dado que los arrendadores ya hab\u00edan perdido su acci\u00f3n inicial, que pretend\u00eda negar la condici\u00f3n de arrendatario, no pod\u00edan ejercer una acci\u00f3n similar basada en un fundamento jur\u00eddico diferente.<\/span><\/p>\n<p><span>Haciendo referencia al art\u00edculo 1351 del c\u00f3digo civil, que establece que el principio de cosa juzgada exige que se solicite el mismo asunto y con base en la misma causa, la Corte de Casaci\u00f3n critica la sentencia de apelaci\u00f3n.\u00a0La Corte argumenta que una decisi\u00f3n con fuerza de cosa juzgada, que vers\u00f3 sobre la solicitud de embargo, no debi\u00f3 decidir sobre la solicitud de extinci\u00f3n del derecho a permanecer en el inmueble.<\/span><\/p>\n<p><span>Por lo tanto, el ejercicio del derecho de recuperaci\u00f3n no equivale a la p\u00e9rdida del derecho a permanecer en el local.\u00a0Estas son dos solicitudes legales distintas, y es irrelevante que conduzcan al mismo resultado, a saber, la partida del inquilino.<\/span><\/p>\n<p><span>Mediante esta sentencia, la Corte de Casaci\u00f3n reafirma un precedente establecido.<\/span><\/p>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"et_pb_row et_pb_row_3\">\n<div class=\"et_pb_column et_pb_column_4_4 et_pb_column_5  et_pb_css_mix_blend_mode_passthrough et-last-child\">\u00a0<\/div>\n<\/div>\n<\/div>\n<p>[\/et_pb_text][\/et_pb_column][\/et_pb_row][et_pb_row _builder_version=&#8221;4.19.5&#8243; _module_preset=&#8221;default&#8221; custom_margin=&#8221;||0px||false|false&#8221; custom_padding=&#8221;||0px||false|false&#8221; global_colors_info=&#8221;{}&#8221;][et_pb_column type=&#8221;4_4&#8243; _builder_version=&#8221;4.19.5&#8243; _module_preset=&#8221;default&#8221; global_colors_info=&#8221;{}&#8221;][et_pb_divider _builder_version=&#8221;4.19.5&#8243; _module_preset=&#8221;default&#8221; global_colors_info=&#8221;{}&#8221;][\/et_pb_divider][\/et_pb_column][\/et_pb_row][\/et_pb_section]<\/p>\n","protected":false},"excerpt":{"rendered":"<p>El Derecho del Arrendatario Sujeto a la Ley N\u00fam. 48-1360 del 1 de septiembre de 1948 El arrendatario sujeto a la Ley No. 48-1360 del 1 de septiembre de 1948, puede enfrentar la posibilidad de perder su derecho a permanecer en el local por ciertas razones especificadas en el Art\u00edculo 10.
