En sentencia de\u00a0<\/span>4 de julio de 2012<\/span><\/a>, la primera sala civil del Tribunal de Casaci\u00f3n desestim\u00f3 el recurso: “dado que es en el ejercicio de su poder soberano que el Tribunal de Apelaci\u00f3n tiene, a la vista de todos los documentos aportados en el procedimiento y sin desnaturalizarlos, sobre por un lado, consider\u00f3 que como \u00fanica fuente de ingresos del matrimonio, no hab\u00eda contribuido en proporci\u00f3n a sus ingresos a los gastos del hogar y al mantenimiento del domicilio conyugal y hab\u00eda mostrado prepotencia en la vida familiar y dedujo de ello que estos hechos constitu\u00edan un grave y renovado violaci\u00f3n de los deberes y obligaciones del matrimonio justificando el pronunciamiento del divorcio por sus culpas exclusivas, por otra parte,consider\u00f3 que la ruptura del matrimonio cre\u00f3 en las condiciones de vida de los c\u00f3nyuges una disparidad cuya compensaci\u00f3n exig\u00eda la asignaci\u00f3n a su c\u00f3nyuge del subsidio compensatorio que \u00e9ste fijaba en su cuant\u00eda;<\/span><\/p>\n

que estas razones, que escapan a los agravios de los medios, justifican jur\u00eddicamente su decisi\u00f3n.\u00a0\u00bb<\/span><\/p>\n

En este caso, la indemnizaci\u00f3n compensatoria es de 200.000 euros.<\/span><\/p>\n
