sticky_enabled=&#8221;0&#8243;]<\/p>\n<div class=\"entry-content\">\n<h2><span>Ley nro.\u00a02012-955 del 6 de agosto de 2012 destinada a derogar la ley n.\u00a02012-376 de 20 de marzo de 2012 relativa al aumento de derechos de edificaci\u00f3n.<\/span><\/h2>\n<p><span>La Ley N\u00b0 2012-376 del 20 de marzo de 2012 sobre el aumento de los derechos de construcci\u00f3n aument\u00f3 en un 30% hasta el 1 de enero de 2016 los derechos de construcci\u00f3n para la ampliaci\u00f3n o construcci\u00f3n de edificios para uso residencial en municipios cubiertos por un plan de uso del suelo (POS), un\u00a0<\/span><a href=\"https:\/\/www.collectivites-locales.gouv.fr\/competences\/les-plans-locaux-durbanisme\"><span>plan urban\u00edstico local (PLU)<\/span><\/a><span>\u00a0o un plan de desarrollo zonal (PAZ).<\/span><\/p>\n<p><span>Cabr\u00eda preguntarse sobre la pertinencia de esta derogaci\u00f3n en la medida en que los incrementos resultantes de la aplicaci\u00f3n del antiguo texto y vigentes al momento de la promulgaci\u00f3n de la nueva ley contin\u00faan aplic\u00e1ndose a las solicitudes de permisos y declaraciones presentadas antes del 1 de enero de 2016.<\/span><\/p>\n<p><span><span class=\"\">Cabe a\u00f1adir que la ley de 6 de agosto tambi\u00e9n modifica el art\u00edculo L. 123-1-11 del C\u00f3digo de Urbanismo al reducir al 20 % (frente al 30 % anterior) el posible recargo autorizado para las normas relativas al tama\u00f1o, la altura, huella y coeficiente de ocupaci\u00f3n de suelo para la ampliaci\u00f3n o construcci\u00f3n de edificios de uso residencial.<\/span><\/span><br \/><span>Esta nueva medida, que sigue a un tope de alquiler reducido, plantea algunas preguntas sobre la esencia de la pol\u00edtica destinada a frenar el problema de la vivienda en Francia.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><a href=\"https:\/\/gregorydamy.niceavocats.fr\/\"><span>Ma\u00eetre Gr\u00e9gory Damy<\/span><\/a><span>\u00a0Real Estate Law, Niza, ACTUALIZACI\u00d3N 2022<\/span><\/p>\n<\/div>\n<p>[\/et_pb_text][\/et_pb_column][\/et_pb_row][et_pb_row _builder_version=&#8221;4.19.5&#8243;
