S\u2019appuyant sur les conditions g\u00e9n\u00e9rales de vente de Free, le tribunal d\u2019instance de Lyon a estim\u00e9 que Free n\u2019avait commis aucune faute en livrant la Free V6 plus de quatre mois apr\u00e8s la commande.<\/h2>\n

Dans son jugement du 29 juin 2012, le juge estime qu\u2019au vu de ses obligations contractuelles, le fournisseur d\u2019acc\u00e8s n\u2019\u00e9tait tenu par aucun d\u00e9lai. Il \u00e9tait pr\u00e9vu que le modem \u00e9tait mis \u00e0 la disposition des abonn\u00e9s \u00ab sous r\u00e9serve d\u2019\u00e9ligibilit\u00e9 et de disponibilit\u00e9 \u00bb. L\u2019abonn\u00e9 avait \u00e9t\u00e9 inform\u00e9 par email ou sur le site de Free que le nombre de livraison \u00e9tait limit\u00e9 en raison des difficult\u00e9s de fabrication et d\u2019acheminement occasionn\u00e9es par la catastrophe de Fukushima et que le d\u00e9lai pourrait atteindre plusieurs mois.
Le juge rejette par ailleurs la demande d\u2019indemnisation de l\u2019abonn\u00e9 au motif qu\u2019il n\u2019a subi aucun pr\u00e9judice puisqu\u2019il disposait d\u00e9j\u00e0 d\u2019une box et qu\u2019il n\u2019a pas eu \u00e0 souffrir d\u2019une majoration des tarifs.<\/p>\n
