sticky_enabled=&#8221;0&#8243;]<\/p>\n<div class=\"entry-content\">\n<div class=\"entry-content\">\n<p><span><span class=\"\">Uso mixto Durante el plazo de un contrato de arrendamiento de uso mixto, el inquilino no est\u00e1 obligado a utilizar el local para fines residenciales y profesionales.\u00a0<\/span>Sin embargo, el derecho a renovar el contrato de arrendamiento est\u00e1 supeditado a que el arrendatario ocupe al menos parcialmente el local como su residencia principal al final del\u00a0<\/span><a href=\"https:\/\/www.justice.fr\/\"><span>contrato<\/span><\/a><span>\u00a0.<\/span><\/p>\n<h2><span>Antecedentes y condiciones de arrendamiento:-<\/span><\/h2>\n<p><span>En un caso concreto, se concedi\u00f3 un contrato de arrendamiento a una sociedad civil profesional de abogados para alojar a uno de sus miembros y realizar sus actividades profesionales.<\/span><\/p>\n<p><span>El arrendador, alegando que el local se utilizaba \u00fanicamente con fines profesionales, notific\u00f3 al arrendatario.\u00a0El aviso no fue emitido en virtud del art\u00edculo 15 de la Ley n\u00b0 89-462 de 6 de julio de 1989, sino \u201cde conformidad con las disposiciones del c\u00f3digo civil, las condiciones de su contrato de arrendamiento y el art\u00edculo L. 632-1 de la c\u00f3digo de construcci\u00f3n y vivienda\u201d, que se refiere a los alquileres amueblados.<\/span><\/p>\n<h2><span>Disputas y Procedimientos Legales:-<\/span><\/h2>\n<p><span>El propietario llev\u00f3 el asunto a los tribunales cuando el inquilino se neg\u00f3 a cumplir, buscando la validaci\u00f3n del aviso y el desalojo del ocupante.\u00a0Sin embargo, el recurso del arrendador no prosper\u00f3 (Par\u00eds, 31 de mayo de 2011, AJDI 2012. 272), ya que el despido no acredit\u00f3 ninguna de las causas previstas en el art\u00edculo 15. Es importante se\u00f1alar que el art\u00edculo 15 no permite que el arrendador emitir un aviso \u00fanicamente para embargo, venta o una\u00a0raz\u00f3n\u00a0<\/span><a href=\"https:\/\/gregorydamy.niceavocats.fr\/decision-de-la-2\/\"><span>leg\u00edtima y grave.<\/span><\/a><\/p>\n<p><span>Ante el juez, con base en la citada jurisprudencia del Pleno de la Corte de Casaci\u00f3n, l\u00f3gicamente se desestim\u00f3 la alegaci\u00f3n del arrendador de que no se deb\u00eda aplicar la ley de 1989 por el uso exclusivamente profesional del local.<\/span><\/p>\n<p><span>Sin embargo, el arrendador tambi\u00e9n aleg\u00f3, como alternativa, que el uso profesional exclusivo del local por parte del arrendatario constitu\u00eda un motivo leg\u00edtimo y grave para denegar la renovaci\u00f3n del contrato de arrendamiento en los t\u00e9rminos del art\u00edculo 15-I de la ley.\u00a0En tales circunstancias, se retuvo la existencia de un motivo grave y leg\u00edtimo, en el entendido de que un arrendador no est\u00e1 actuando de mala fe al emitir un aviso por un motivo leg\u00edtimo y grave despu\u00e9s de haber permitido o provocado la renovaci\u00f3n del contrato en m\u00faltiples ocasiones. .<\/span><\/p>\n<p><span>El Tribunal Supremo, de hecho, critic\u00f3 la decisi\u00f3n del juez parisino por desconocer la existencia de tal motivo sin reconocer el uso por parte del arrendatario del local alquilado como su residencia principal, al menos parcialmente, al t\u00e9rmino del contrato.\u00a0Afortunadamente, el aviso fue notificado con m\u00e1s de seis meses de anticipaci\u00f3n al vencimiento del contrato (28 de marzo para el 30 de septiembre), cumpliendo as\u00ed con el plazo prescrito por la ley de 1989 (Abogado de negocios, 2020).<\/span><\/p>\n<\/div>\n<\/div>\n<p>[\/et_pb_text][\/et_pb_column][\/et_pb_row][et_pb_row _builder_version=&#8221;4.19.5&#8243; _module_preset=&#8221;default&#8221; custom_margin=&#8221;||0px||false|false&#8221; custom_padding=&#8221;||0px||false|false&#8221; global_colors_info=&#8221;{}&#8221;][et_pb_column type=&#8221;4_4&#8243; _builder_version=&#8221;4.19.5&#8243; _module_preset=&#8221;default&#8221; global_colors_info=&#8221;{}&#8221;][et_pb_divider _builder_version=&#8221;4.19.5&#8243; _module_preset=&#8221;default&#8221; global_colors_info=&#8221;{}&#8221;][\/et_pb_divider][\/et_pb_column][\/et_pb_row][\/et_pb_section]<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Uso mixto Durante el plazo de un contrato de arrendamiento de uso mixto, el inquilino no est\u00e1 obligado a utilizar el local para fines residenciales y profesionales.\u00a0Sin embargo, el derecho a renovar el contrato de arrendamiento est\u00e1 supeditado a que el arrendatario ocupe al menos parcialmente el local como su residencia principal al final del\u00a0contrato\u00a0.
