background_repeat=&#8221;repeat&#8221; hover_enabled=&#8221;0&#8243; global_colors_info=&#8221;{}&#8221; sticky_enabled=&#8221;0&#8243;]<\/p>\n<h2><span>Terminaci\u00f3n convencional invalidada<\/span><\/h2>\n<p><span>La rescisi\u00f3n convencional permite al empleador y al empleado vinculados por un contrato indefinido (CDI) acordar mutuamente los t\u00e9rminos de rescisi\u00f3n del contrato de trabajo que los vincula.<\/span><\/p>\n<p><span>Sin embargo, esta modalidad de rescisi\u00f3n del contrato de trabajo prevista por la ley est\u00e1 abierta a determinados empleados en determinadas condiciones.\u00a0Por ejemplo, no es v\u00e1lida una extinci\u00f3n convencional del contrato de trabajo que se produzca en un contexto de acoso moral.\u00a0As\u00ed lo decidi\u00f3 recientemente el Tribunal de Casaci\u00f3n.<\/span><\/p>\n<p><span>Una empleada, de baja por un estado depresivo directamente relacionado con sus condiciones de trabajo y v\u00edctima de acoso moral por parte del empresario, se vio obligada a firmar una rescisi\u00f3n contractual el mismo d\u00eda de su regreso al trabajo.<\/span><\/p>\n<h2><span>Acoso moral y despido<\/span><\/h2>\n<p><span>El Tribunal de Casaci\u00f3n ha dictaminado que la extinci\u00f3n de un contrato de trabajo en el contexto de acoso moral no es v\u00e1lida.\u00a0En un caso reciente, un empleado que estaba de baja por enfermedad debido a un estado depresivo causado por sus condiciones de trabajo y que hab\u00eda sufrido acoso moral por parte del empleador, se vio obligado a firmar una rescisi\u00f3n contractual el mismo d\u00eda de su regreso al trabajo.\u00a0El Tribunal consider\u00f3 que tal despido obtenido en tales circunstancias no puede considerarse dado libremente, trat\u00e1ndolo como un despido sin justa causa.\u00a0Esta decisi\u00f3n tiene como objetivo prevenir abusos y proteger a los empleados de un trato injusto.<\/span><\/p>\n<p><span>Seg\u00fan los jueces, cuando la extinci\u00f3n del contrato se produce en tales condiciones, el consentimiento del trabajador no puede darse libremente.\u00a0En consecuencia, esta terminaci\u00f3n produce los efectos de un despido sin causa real y grave que d\u00e9 derecho a indemnizaci\u00f3n.<\/span><\/p>\n<p><span>En sentencia de 2019, la Sala de lo Social (1) neutraliza la posibilidad de utilizar el acoso moral para obtener la nulidad de una extinci\u00f3n convencional del contrato de trabajo.\u00a0La falta de prueba de la falta de consentimiento contin\u00faa, por tanto, excluyendo dicha nulidad y permite as\u00ed evitar cualquier abuso por parte del solicitante.<\/span><\/p>\n<p><span>1\/ Tribunal de Casaci\u00f3n, civil, Sala Social, 23 de enero de 2019, 17-21.550:\u00a0<\/span><a href=\"https:\/\/www.legifrance.gouv.fr\/juri\/id\/JURITEXT000038091458\" target=\"_new\" rel=\"noopener\"><span>https:\/\/www.legifrance.gouv.fr\/juri\/id\/JURITEXT000038091458<\/span><\/a><\/p>\n<p><a href=\"https:\/\/gregorydamy.niceavocats.fr\/\"><span>Gabinete DAMY<\/span><\/a><span>\u00a0, Niza, Derecho del Trabajo, Actualizaci\u00f3n 2021.<\/span><\/p>\n<p>[\/et_pb_text][\/et_pb_column][\/et_pb_row][et_pb_row _builder_version=&#8221;4.19.5&#8243;
