background_repeat=&#8221;repeat&#8221; hover_enabled=&#8221;0&#8243; global_colors_info=&#8221;{}&#8221; sticky_enabled=&#8221;0&#8243;]<\/p>\n<h2><span>En sentencia dictada el 27 de julio de 2012, el Consejo de Estado declar\u00f3 ilegales las disposiciones contenidas en un documento urban\u00edstico local (antiguo POS o PLU) que proh\u00edban en principio o limiten la facultad reconocida a cualquier propietario de parcelar su terreno.<\/span><\/h2>\n<p><span>Sus autores no tienen competencia para prohibir la facultad concedida a los propietarios para proceder, en las condiciones previstas en el Libro IV del C\u00f3digo de Urbanismo, a la divisi\u00f3n de los bienes inmuebles con vistas a la construcci\u00f3n de edificios, facultad que contribuye a la el ejercicio de su derecho a disponer de sus bienes.<\/span><\/p>\n<p><span>El Consejo de Estado juzga \u201cque al prohibir en principio las adjudicaciones en una o m\u00e1s zonas que delimita, el reglamento de un plan de ordenamiento territorial o de un plan urban\u00edstico local dicta reglas que exceden las que la ley le autoriza a prescribir\u201d.\u00a0S\u00f3lo el legislador puede as\u00ed fijar los l\u00edmites, prohibir de manera general y absoluta la creaci\u00f3n de lotificaciones en una o m\u00e1s zonas.<\/span><\/p>\n<p><span>Considera que esta opci\u00f3n es parte del ejercicio del derecho a disponer de su propiedad.\u00a0<\/span><a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000006428859\/2011-10-24\"><span>El art\u00edculo 544 del C\u00f3digo Civil<\/span><\/a><span>\u00a0establece que la propiedad es el derecho de disfrutar y disponer de las cosas de la manera m\u00e1s absoluta y el art\u00edculo 17 de la Declaraci\u00f3n de los Derechos del Hombre y del Ciudadano califica la propiedad como \u201cderecho inviolable y sagrado\u201d.<\/span><\/p>\n<p><span>Esta libertad, fundamental, facilita la victoria de lo urbano sobre lo rural y la banalizaci\u00f3n, la estandarizaci\u00f3n, de los paisajes.\u00a0El debate permanece.<\/span><\/p>\n<p><a href=\"https:\/\/gregorydamy.niceavocats.fr\/\"><span>Bufete de abogados DAMY<\/span><\/a><\/p>\n<p>[\/et_pb_text][\/et_pb_column][\/et_pb_row][et_pb_row _builder_version=&#8221;4.19.5&#8243;
