background_repeat=&#8221;repeat&#8221; hover_enabled=&#8221;0&#8243; global_colors_info=&#8221;{}&#8221; sticky_enabled=&#8221;0&#8243;]<\/p>\n<p><span>Con una extensi\u00f3n de 300 p\u00e1ginas y abordando multitud de cuestiones diversas, el texto pronto se denominar\u00eda \u201cley fluvial\u201d o incluso \u201ccatedral legislativa\u201d, para evitar la simple expresi\u00f3n de \u201cley general\u201d.<\/span><\/p>\n<h2><span>Complejidad y Desaf\u00edos de la Ley Duflot<\/span><\/h2>\n<p><span>Evidentemente, no se usurpan tales calificativos: complejidad de la legislaci\u00f3n aplicable a los distintos contratos de arrendamiento de vivienda, reforma en profundidad del marco que regula las condiciones de ejercicio de las profesiones inmobiliarias, refuerzo del formalismo necesario para las operaciones de compraventa de bienes inmuebles patrimonio, evoluci\u00f3n cambios sustanciales en las normas urban\u00edsticas\u2026 Todos los actores interesados \u200b\u200bse encuentran en esta primavera de 2014 con numerosas dificultades para evaluar las consecuencias que tales cambios tendr\u00e1n en el ejercicio diario de su actividad, y las inquietudes expresadas parecen justificadas, para decir lo m\u00ednimo.<\/span><\/p>\n<p><span>As a central actor in real estate transactions and real estate management, the real estate agent will demonstrate more of a great capacity for adaptation, in the medida in which Ley Duflot has profoundly modified the organization and the conditions of ejercicio de su profession, al tiempo that increases the number of obligations that the incumbent during the ejecuci\u00f3n of his mission.<\/span><\/p>\n<h2><span>Formalismo y Obligaciones en la Venta de Lotes en Condominio<\/span><\/h2>\n<p><span>Con el deseo de informar m\u00e1s eficazmente a los possible compradores de lotes en coproppiedad de los riesgos que esta compra puede presentar, el legislador ha &#8220;definitivamente el centro de gravedad de la compraventa&#8221;, al multiply las reglas de form que deben respetarse tanto en el anuncio de la venta de la propiedad y en el contrato de venta.<\/span><\/p>\n<p><span>En particular, el art\u00edculo 54 de la ley crea un nuevo\u00a0<\/span><a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000039369572\"><span>art\u00edculo L721-1 en el C\u00f3digo de Construcci\u00f3n y Vivienda<\/span><\/a><span>\u00a0, disponiendo que:<\/span><\/p>\n<p><span>\u201cLos anuncios relativos a la venta de un lote o parte de un lote de un inmueble sujeto a la condici\u00f3n de copropiedad deber\u00e1n mencionar:<\/span><\/p>\n<p><span>1\u00b0 El hecho de que la propiedad est\u00e9 sujeta al estado de copropiedad;\u00a02\u00b0 El n\u00famero de lotes;\u00a03\u00b0 El importe medio anual de la parte, a cargo del vendedor, del presupuesto provisional correspondiente a los gastos corrientes definidos en el art\u00edculo 14-1 de la ley n\u00b0 65-557, de 10 de julio de 1965, que establece el estatuto de la copropiedad de edificios construidos.<\/span><\/p>\n<p><span>Los anuncios tambi\u00e9n deben especificar si el sindicato de copropietarios es objeto de procedimientos llevados a cabo sobre la base de los art\u00edculos 29-1 A y 29-1 de la citada ley n\u00b0 65-557 de 10 de julio de 1965 y el art\u00edculo L. 615-6 de este c\u00f3digo.\u00a0\u00bb<\/span><\/p>\n<p><span>\u00bfSignifica esto que el mercado de venta de lotes en condominio est\u00e1 a punto de sufrir las nefastas consecuencias de un formalismo considerado por algunos demasiado r\u00edgido?\u00a0La respuesta merece un matiz considerable, por dos razones.<\/span><\/p>\n<p><span>Por un lado, el legislador no ha previsto ninguna sanci\u00f3n espec\u00edfica para tales obligaciones.<\/span><\/p>\n<p><span>Por otro lado, parece muy poco probable que el anuncio de la venta de un inmueble sea lo suficientemente preciso y completo para poder ser aceptado incondicionalmente, por lo que en la pr\u00e1ctica s\u00f3lo puede constituir una invitaci\u00f3n a iniciar negociaciones y no una oferta. excluyendo as\u00ed cualquier perspectiva de sanci\u00f3n en t\u00e9rminos de derecho contractual.<\/span><\/p>\n<p><span>La conclusi\u00f3n resultante parece bastante simple: los agentes inmobiliarios no tienen, por el momento, la obligaci\u00f3n real de incluir en sus anuncios de venta de lotes en copropiedad la informaci\u00f3n mencionada en el art\u00edculo L721-1 del C\u00f3digo.\u00a0construcci\u00f3n y vivienda.<\/span><\/p>\n<p><span>Without embargo, the early adoption of a code of ethics, supervised by the newly created commission for the control of management activities and real estate transactions, may reasonably be expected to bring about disciplinary sanctions.<\/span><\/p>\n<p><a href=\"https:\/\/gregorydamy.niceavocats.fr\/\"><span>Bufete de abogados DAMY<\/span><\/a><\/p>\n<p>[\/et_pb_text][\/et_pb_column][\/et_pb_row][et_pb_row _builder_version=&#8221;4.19.5&#8243;
