background_repeat=&#8221;repeat&#8221; hover_enabled=&#8221;0&#8243; global_colors_info=&#8221;{}&#8221; sticky_enabled=&#8221;0&#8243;]<\/p>\n<p><span class=\"VIpgJd-yAWNEb-VIpgJd-fmcmS-sn54Q\"><span>El contrato de trabajo puede incluir una cl\u00e1usula de no competencia, que proh\u00edba al empleado, despu\u00e9s de dejar la empresa, ejercer una actividad competidora que pueda perjudicar los intereses del\u00a0\u00a0<\/span><\/span><span class=\"VIpgJd-yAWNEb-VIpgJd-fmcmS-sn54Q\"><span>empleador\u00a0<\/span><\/span><span class=\"VIpgJd-yAWNEb-VIpgJd-fmcmS-sn54Q\"><span>\u00a0.<\/span><\/span><\/p>\n<p><span>Su validez est\u00e1 sujeta a las siguientes condiciones acumulativas:<\/span><\/p>\n<p><span>\u2013 ser esencial para la preservaci\u00f3n de los intereses leg\u00edtimos de la empresa<\/span><br \/><span>\u2013 tener en cuenta las especificidades del trabajo del empleado<\/span><br \/><span>\u2013 ser limitado en el tiempo<\/span><br \/><span>\u2013 ser limitado en el espacio<\/span><br \/><span>\u2013 prever una compensaci\u00f3n financiera<\/span><\/p>\n<h2><span>El contrato de trabajo: &#8211;<\/span><\/h2>\n<p><span>Con efectos desde la extinci\u00f3n del contrato de trabajo, la obligaci\u00f3n de no concurrencia no caduca por efecto del cese de actividad de la empresa, aunque ya no exista el riesgo.<\/span><\/p>\n<p><span>La sala de lo social del Tribunal de Casaci\u00f3n resolvi\u00f3 el 21 de enero de 2015 (\u00a0<\/span><a href=\"https:\/\/www.legifrance.gouv.fr\/juri\/id\/JURITEXT000030142945\/\"><span>SOC. 21 de enero de 2015, recurso n\u00fam.: 13-26374<\/span><\/a><span>\u00a0).<\/span><\/p>\n<p><span>En este caso, un trabajador sujeto a una obligaci\u00f3n de no competencia durante 3 a\u00f1os recurri\u00f3 al tribunal laboral, en particular con el fin de obtener el pago de la contraprestaci\u00f3n pecuniaria correspondiente.\u00a0Se pronuncia entonces la liquidaci\u00f3n judicial de la empresa.<\/span><\/p>\n<h2><span>El tribunal:-<\/span><\/h2>\n<p><span>El Tribunal de Apelaci\u00f3n despidi\u00f3 a la empleada, consider\u00e1ndola liberada de su obligaci\u00f3n a partir del cese de actividad de la empresa.<\/span><\/p>\n<p><span class=\"\"><span>Sin embargo, la sala de lo social del Tribunal de Casaci\u00f3n resolvi\u00f3 lo contrario, al considerar que:<\/span><\/span><br \/><span class=\"\"><span>\u201cla cl\u00e1usula de no concurrencia surtiendo efectos a la extinci\u00f3n del contrato de trabajo, la terminaci\u00f3n posterior de la actividad del empleador no tiene por efecto relevar al trabajador de su no concurrencia\u201d. obligaci\u00f3n;<\/span><\/span><\/p>\n<p><span>Que al pronunciarse como lo hizo, cuando la trabajadora no hab\u00eda sido liberada de su obligaci\u00f3n por el empleador y que por tanto le correspond\u00eda examinar la solicitud de pago de la compensaci\u00f3n econ\u00f3mica a prorrata del tiempo de ejecuci\u00f3n de la no -obligaci\u00f3n de competencia, el Tribunal de Apelaci\u00f3n viol\u00f3 dicho texto;\u00a0\u00bb<\/span><\/p>\n<p><span>As\u00ed, sobreviviendo la obligaci\u00f3n de no concurrencia al cese de actividad de la empresa, el trabajador tiene derecho a reclamar la compensaci\u00f3n econ\u00f3mica que le corresponde, incluso en el supuesto de liquidaci\u00f3n judicial posterior al\u00a0\u00a0<\/span><span>cese\u00a0<\/span><span>.\u00a0<\/span><\/p>\n<p><a href=\"https:\/\/gregorydamy.niceavocats.fr\/notre-equipe\/\"><span>ABOGADOS DAMY\u00a0<\/span><\/a><\/p>\n<p>[\/et_pb_text][\/et_pb_column][\/et_pb_row][et_pb_row _builder_version=&#8221;4.19.5&#8243;
