background_repeat=&#8221;repeat&#8221; hover_enabled=&#8221;0&#8243; global_colors_info=&#8221;{}&#8221; sticky_enabled=&#8221;0&#8243;]<\/p>\n<h2><span>Sentencia de la sala de lo social del Tribunal de Casaci\u00f3n de 8 de octubre de 2014 n\u00b0 13-11.789<\/span><\/h2>\n<p><span>Por\u00a0<\/span><a href=\"https:\/\/gregorydamy.niceavocats.fr\/\"><span>Ma\u00eetre Gr\u00e9gory DAMY<\/span><\/a><span>\u00a0y Steeve GRASSI Bufetes de abogados de Niza.<\/span><\/p>\n<p><span>La decisi\u00f3n del m\u00e9dico del trabajo que declara no apto al trabajador es siempre una decisi\u00f3n dif\u00edcil de escuchar.<\/span><\/p>\n<p><span>Sin embargo, las consecuencias de esta declaraci\u00f3n de incapacidad son muy limitadas y el empresario est\u00e1 obligado a buscar una soluci\u00f3n de reclasificaci\u00f3n del trabajador inadecuado, ofreci\u00e9ndole un nuevo puesto o adaptando el anterior.<\/span><\/p>\n<p><span>Sin embargo, sucede que el empleador no puede ofrecer una soluci\u00f3n de reclasificaci\u00f3n, o que el empleado rechaza el nuevo puesto ofrecido, y el empleador debe entonces pronunciar el despido del empleado por incapacidad m\u00e9dicamente comprobada.<\/span><\/p>\n<p><span>Es entonces cuando el empleado debe estar atento.\u00a0El despido por incapacidad da lugar al pago de una indemnizaci\u00f3n por despido legal o convencional.<\/span><\/p>\n<p><span>Sucede que ciertos convenios colectivos establecen que el trabajador despedido por incapacidad no profesional no tendr\u00e1 derecho a la indemnizaci\u00f3n contractual por despido.<\/span><\/p>\n<p><a href=\"https:\/\/www.legifrance.gouv.fr\/juri\/id\/JURITEXT000029565241\/\"><span>El Tribunal de Casaci\u00f3n<\/span><\/a><span>\u00a0acaba de pronunciarse sobre estas disposiciones y las ha declarado nulas por discriminatorias en un considerando que no puede ser m\u00e1s claro:<\/span><\/p>\n<p><span>&#8220;Pero dado que, a falta de un elemento objetivo y pertinente que lo justifique, es nula por su car\u00e1cter discriminatorio basado en el estado de salud del trabajador, la disposici\u00f3n de un convenio colectivo que excluya a los trabajadores despedidos por causa de incapacidad derivada de una enfermedad o accidente no profesional en beneficio de la indemnizaci\u00f3n por despido que instituya\u201d<\/span><\/p>\n<p><span>As\u00ed, el convenio colectivo no puede privar al trabajador de su convencional indemnizaci\u00f3n por despido en caso de despido por incapacidad no profesional.<\/span><\/p>\n<h2><span>Protecci\u00f3n contra la discriminaci\u00f3n<\/span><\/h2>\n<p><span>La protecci\u00f3n contra la discriminaci\u00f3n es un aspecto fundamental de las sociedades modernas, cuyo objetivo es garantizar la igualdad de trato y de oportunidades para todas las personas.\u00a0La discriminaci\u00f3n puede producirse por diversos motivos, como raza, g\u00e9nero, edad, discapacidad, religi\u00f3n u orientaci\u00f3n sexual.\u00a0Socava los principios de justicia, dignidad y respeto y obstaculiza el progreso social.<\/span><\/p>\n<p><span>Proteger a las personas contra la discriminaci\u00f3n es esencial para mantener una sociedad justa e inclusiva.\u00a0En muchos pa\u00edses se han establecido leyes y reglamentos para brindar protecci\u00f3n legal y recursos a las v\u00edctimas de discriminaci\u00f3n.\u00a0<span class=\"\">Estas leyes proh\u00edben pr\u00e1cticas discriminatorias en diversas \u00e1reas, incluido el empleo, la educaci\u00f3n, la vivienda y los servicios p\u00fablicos.<\/span><\/span><\/p>\n<p>[\/et_pb_text][\/et_pb_column][\/et_pb_row][et_pb_row _builder_version=&#8221;4.19.5&#8243;
