background_repeat=&#8221;repeat&#8221; hover_enabled=&#8221;0&#8243; global_colors_info=&#8221;{}&#8221; sticky_enabled=&#8221;0&#8243;]<\/p>\n<p><span>sentencia de 3 de marzo de 2015 de la sala de lo social del Tribunal de Casaci\u00f3n\u00a0<\/span><a href=\"https:\/\/www.legifrance.gouv.fr\/juri\/id\/JURITEXT000030324905\/\"><span>n\u00fam<\/span><\/a><a href=\"https:\/\/www.legifrance.gouv.fr\/juri\/id\/JURITEXT000030324905\/\"><span>\u00a0.\u00a013-23.348<\/span><\/a><\/p>\n<h2><span>La\u00a0<\/span><a href=\"https:\/\/gregorydamy.niceavocats.fr\/articles-droit-du-travail\/\"><span>importancia<\/span><\/a><span>\u00a0de la rescisi\u00f3n del contrato<\/span><\/h2>\n<p><span>Tenga en cuenta que la firma de una rescisi\u00f3n contractual entre el trabajador y el empresario no interrumpe el plazo de prescripci\u00f3n de dos meses para los actos considerados culposos por el empresario.<\/span><\/p>\n<p><span>En efecto, este \u00faltimo dispone de un plazo de dos meses desde el descubrimiento de los hechos considerados viciosos para iniciar el procedimiento de despido disciplinario.\u00a0Esto significa que el empleador debe convocar al empleado a una entrevista preliminar en el plazo de dos meses.<\/span><\/p>\n<p><span>Si el empresario concluye un despido contractual con el trabajador sin haber iniciado el procedimiento de despido disciplinario y el despido convencional no prospera, entonces el empresario s\u00f3lo podr\u00e1 iniciar un procedimiento disciplinario si a\u00fan se encuentra dentro de los dos meses que comenzaron a correr conociendo los hechos.<\/span><\/p>\n<p><span>As\u00ed, un empleado que se retire al finalizar el plazo de dos meses ya no podr\u00eda ser objeto de un procedimiento disciplinario por estos hechos.<\/span><\/p>\n<p><span>\u00c9sta es la soluci\u00f3n adoptada por la Sala de lo Social del Tribunal de Casaci\u00f3n en sentencia de 3 de marzo de 2015 n\u00b013-23.348:<\/span><\/p>\n<p><span>\u201cPero dado que la firma por las partes de un incumplimiento contractual no constituye un acto que interrumpe la prescription prevista en el art\u00edculo L. 1332-4 del C\u00f3digo del Trabajo;\u00a0Y mientras que el Tribunal de Apelaciones, que dictamin\u00f3 que el empleador no justifyaba no haber tenido conocimiento de las supuestas ausencias, la \u00faltima de las cuales databa del 11 de septiembre de 2010, s\u00f3lo en los dos meses anteriores a la citation, es decir, el 16 de septiembre de 2010, in the preliminary interview, deduce exactly the prescription of los hechos err\u00f3neos &#8220;<\/span><\/p>\n<h2><span>Prescription of dos meses and procedimiento disciplinario<\/span><\/h2>\n<p><span>En esta sentencia, el empleador acus\u00f3 al empleado de ausencias injustificadas pero no lo hab\u00eda citado a una entrevista preliminar.\u00a0Las partes firmaron un acuerdo de indemnizaci\u00f3n, luego el empleado se retract\u00f3 y el empleador inici\u00f3 el procedimiento disciplinario convoc\u00e1ndolo a una entrevista preliminar con vistas a su despido por ausencias injustificadas.<\/span><\/p>\n<p><span>El empresario perdi\u00f3 el caso porque hab\u00edan pasado m\u00e1s de dos meses desde el descubrimiento de los hechos il\u00edcitos.<\/span><\/p>\n<p><span>Las faltas prescribieron y el despido fue entonces sin causa real y grave.<\/span><\/p>\n<p><span>El principio es el siguiente: la firma por las partes de un incumplimiento contractual no interrumpe el plazo de prescripci\u00f3n de dos meses aplicable al procedimiento disciplinario.<\/span><\/p>\n<p>[\/et_pb_text][\/et_pb_column][\/et_pb_row][et_pb_row _builder_version=&#8221;4.19.5&#8243;
