background_repeat=&#8221;repeat&#8221; hover_enabled=&#8221;0&#8243; global_colors_info=&#8221;{}&#8221; sticky_enabled=&#8221;0&#8243;]<\/p>\n<div class=\"entry-content\">\n<h2><span>Request for delay and suspension: termination of the commercial lease<\/span><\/h2>\n<p><span class=\"\"><span>According to\u00a0<\/span><a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000032042713\/2022-04-21\"><span>Article L. 145-41 of the\u00a0\u00a0<\/span><\/a><\/span><a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000032042713\/2022-04-21\"><span class=\"\"><span>Commercial<\/span><\/span><\/a><span class=\"\"><span>\u00a0Code \u00a0, the holder of a commercial lease has the right to request delays and the suspension of the effects of the resolutory clause, even after the\u00a0\u00a0<\/span><\/span><span class=\"\"><span>expiry of the period of one month from from the\u00a0\u00a0<\/span><\/span><span class=\"\"><span>order\u00a0<\/span><\/span><span class=\"\"><span>\u00a0, as long as the termination of the lease has not been pronounced by a decision having the authority of res judicata.\u00a0<\/span><\/span><span>This provision provides important protections to commercial tenants in the event of a lease termination.<\/span><\/p>\n<h2><span>Nullity of summons: violation of the commercial code and the code of civil procedure<\/span><\/h2>\n<p><span>In one specific case, a landlord submitted an order to a tenant company on October 27, 2009, invoking the termination clause to demand payment of the rent due.\u00a0The tenant, in response, filed a summons opposing the order on December 8, 2009.
