An association for the defense of non-smokers criticized the company operating a caf\u00e9-restaurant for not respecting the ban on smoking on the terrace in front of the establishment, which was covered and protected by tarpaulins.\r\nThe Court of Appeal had rejected the association's request on the grounds that the existence of an open space between the frames and the awning did not allow it to be said that the facade was closed, even if it was not completely open.\r\nThis is not the opinion of the Court of Cassation, which overturned the decision.
