law, with the aim of strengthening social dialogue within companies and granting more freedom to stakeholders.\u00a0This comprehensive reform includes 36 measures, including several key provisions:<\/span><\/p>\n<h2><a href=\"https:\/\/gregorydamy.niceavocats.fr\/articles-droit-du-travail\/\"><span>Simplified negotiations<\/span><\/a><span>\u00a0and consolidation of employee representative bodies:-<\/span><\/h2>\n<p><span>As part of the labor law reform signed by Emmanuel Macron, companies with fewer than 20 and 50 employees benefit from easier negotiation processes with elected officials.\u00a0In addition, the reform introduces the integration of all staff representative bodies into a single entity called the \u201csocial and economic committee\u201d.\u00a0These measures aim to streamline communication and promote more effective social dialogue within companies.<\/span><\/p>\n<p><span>Labor reform refers to changes in labor laws and regulations aimed at improving the conditions and rights of workers in the labor market.\u00a0These reforms are usually implemented by governments or employers in response to various factors such as economic changes, changing work dynamics and societal demands.<\/span><\/p>\n<p><span>One of the main objectives of labor reform is to ensure fair treatment and protection for workers.\u00a0This includes safeguarding their rights to fair wages, reasonable working hours and safe working conditions.\u00a0Labor reform also addresses issues such as workplace discrimination, harassment and child labor, seeking to eliminate these practices and promote equality and dignity in the workplace.<\/span><\/p>\n<h2><span>Flexibility of employment contracts and redefined compensation for industrial tribunals: \u2013<\/span><\/h2>\n<p><span>Emphasizing the flexibility of the labor market, the reform allows companies, through majority agreements, to decide on working hours, remuneration and employee mobility.\u00a0In addition, a scale is established to cap industrial tribunal compensation in the event of unfair dismissal (excluding cases of discrimination or harassment), replacing the amounts previously set by the judge.\u00a0<\/span><span class=\"\"><span>The reduction in the labor court hiring time is another notable development.\u00a0<\/span><\/span><span>These measures are intended to provide employers and employees with greater flexibility while ensuring a balanced framework for\u00a0\u00a0<\/span><span>resolving published on September 23 of the same year in the Official Journal.\u00a0The aim of this reform is to strengthen social dialogue within companies by leaving more freedom to the protagonists.\u00a0No fewer than 36 measures have been put in place, including:<\/span><\/h1>\r\n<h2><span>\u2013 the possibility of negotiating more easily with employees through elected representatives in companies with less than 20 and 50 employees;<\/span><\/h2>\r\n<h3><span>\u2013 the establishment of a\u00a0<\/span><a href=\"https:\/\/gregorydamy.niceavocats.fr\/les-ordonnances-de-2017-qui-refondent-le-droit-du-travail\/nos-publications\/actualites\/actualite-en-droit-du-travail\/l-application-du-recent-bareme-d-indemnites-pour-licenciement-abusif-par-les-conseils-prud-homaux\"><span>scale capping industrial tribunal indemnities<\/span><\/a><span>\u00a0in the event of unfair dismissal (except in the event of discrimination or harassment) whereas until then these indemnities were freely set by the judge (the maximum ceiling is 20 months of salary for 30 years of seniority);<\/span><\/h3>\r\n<h3><span>*- the time limit for entering the industrial tribunal is reduced from 2 years to 1 year for all dismissals;<\/span><\/h3>\r\n<h3><span>*- it is the company, by the conclusion of a majority agreement, which will decide on the duration of the working time, the remuneration and the mobility of the employees;<\/span><\/h3>\r\n<h3><span>\u2013 all employee representative bodies will be brought together in the \u201csocial and economic committee\u201d;<\/span><\/h3>\r\n<h3><span>\u2013 the possibility for companies to adapt the duration of the contracts offered according to the projects envisaged, while providing a framework for short contracts;<\/span><\/h3>\r\n<h3><span>\u2013 the authorization of economic dismissals is brought back to the national level.\u00a0Consequently, a multinational company that is economically healthy on a global level may decide to close a subsidiary in difficulty in France;<\/span><\/h3>\r\n<h3><span>*- the encouragement given to companies that promote teleworking;<\/span><\/h3>\r\n<h3><span>* \u2013 the 25% increase in legal severance pay;<\/span><\/h3>\r\n<h4><span>*Some measures entered into force immediately (the measures we have listed followed
