Every operator is required to provide you with the Internet speed indicated on your contract. In the event of failure to comply with this undertaking, several means of redress exist.

Gather evidence.

When you noticed the malfunction, you called your operator's hotline and it did not follow up. Know that your operator has an obligation of result, and a level of performance to ensure.

To gather evidence, log on to the Internet and make a query by typing in the search engine of your choice:"know the internet speed of your line". An online test is offered, the results of which are sent to your operator by e-mail with acknowledgement of receipt. The technical service department should contact you to find a solution to your problem.

Write to your operator

. If the first step has not been completed, the second step is to write to your Internet service provider with acknowledgement of receipt, reminding them to remedy the deficiencies found. It is important to specify a period of time, evaluated according to your needs, to remedy the situation: a period of seven days is considered reasonable. At the time of this formal notice, you have the possibility to ask your Internet service provider to make a commercial gesture, for the inconvenience caused.

Referral to the court of first instance.

If all these steps have not changed your situation, you must have found alternative solutions, such as going to a cyber café or visiting a friend. You have therefore suffered prejudice, which opens up the possibility of entering the so-called "contentious" phase, by referring the matter to the local judge. The latter will then hear you orally.

This phase is a little longer: it takes about three months to obtain the verdict from the local judge. If the damage is recognised, the judge may order the payment of damages and, if necessary, order the operator to reimburse you for the legal costs incurred in enforcing your rights.
