If your operator continues to bill you and deduct the amount of your subscription, the best way is to SEND A RECOMMENDED LETTER WITH AR TO YOUR HOTLINE, reminding them that they must take note of your cancellation within 10 days of receiving your letter. If necessary, you can directly contact the CONSUMER SERVICE, who must then propose a privileged interlocutor to take note of your cancellation. In the absence of a satisfactory response, you have the opportunity to KNOW THE MEDIATOR OF NEW TECHNOLOGIES by reporting on the previous steps. The latter will have to take into account your request within three months. All exchanges with the mediator remain confidential.
Since the entry into force of the CHÂTEL LAW OF 3 JANUARY 2008, the operator is required to inform you of the RECONDUCTION OF YOUR CONTRACT at least three months before the anniversary date, and no later than one month before the anniversary date. If the operator does not comply with its obligations, you can cancel your subscription at any time, free of charge.
If you have opted for a quarterly payment, you can REQUIRE THE COMPREHENSIVE REFUND OF ADVANCED EXPENSES WITHIN 30 DAYS. The operator can offer you a subscription of 12 months or more. YOU HAVE THE RIGHT TO CANCEL YOUR SUBSCRIPTION AS OF THE TWELFTH MONTH BY REGISTERED LETTER WITH AR. If you cancel before the end of the 12-month period, your operator is entitled to charge you a penalty of one-quarter of the remaining amount due on the basis of your original contract.
BELOW A SEVEN DAY RETRACTION TIME, the operator cannot charge you any fees. After this deadline, the operator may demand reimbursement of the cancellation fees. He/she will then have to provide you with a detailed invoice of the costs incurred by the cancellation.
IN THE CASE OF MIGRATION TO A NEW OPERATOR, the latter may bear the said termination costs. IN THE CASE OF A DYSFUNCTIONING OF YOUR SUBSCRIPTION, you can get closer to your operator and, if necessary, call on a judicial officer to draw up a report and thus assert your rights before the competent jurisdictions.
If these steps have not been successful, you can contact the DGCCRF (Directorate-General for Competition, Consumption and FRAUD RECOGNITION) who, by registered mail, will help you to prove, using your supporting documents, that your operator has not complied with consumer rights. Depending on the extent of the damage suffered and the costs incurred, you may still be able to bring the matter before the local courts or the courts of first instance. Finally, you can enter CONSUMER ASSOCIATIONS AND PART YOUR OPERATOR.
