Economic redundancy and redeployment obligation

The obligation to reclassify is regarded by case law as a genuine condition for dismissal on economic grounds. In other words, regardless of the merits of the economic reason, dismissal is without real and serious cause if the employer has not met its obligation to reclassify.
The Court pointed out in its various rulings that the employer's failure to comply with its obligation to reclassify deprives the dismissal of a genuine and serious cause (Cass. soc. 2 May 2001, Nos. 98-44945 and 98-44946).
The employer must therefore be particularly vigilant, especially if the dismissal is of a collective nature and the employees have significant seniority. In the event of a dispute, it is the employer's responsibility to justify that he or she has sought all possible reclassification options or that a reclassification was impossible (Cass. soc. 5 July 2011 No. 10-14.625).
In practice, the employer must provide the unique records of the Corporation's personnel and, where applicable, of the group companies.
