A fixed-term contract cannot be concluded for the replacement of several employees. An employee hired on fixed-term contracts to replace an absent employee has requested that her contract be reclassified as permanent contracts. Application rejected by the trial judges, who considered that the employee had not held a permanent job in the company different from the position of the employee she was temporarily replacing. Decision censored by the Court of Cassation. Indeed, the judges had found that she had replaced another employee on paid leave during her contract. Also, applying its well-established case law in this area (see our current news of 07/02/2012: replacement fixed-term contracts: conditions of validity), the High Court recalls that a fixed-term contract cannot be concluded for the replacement of several employees.
