Moral harassment: between confirmations, clarifications and draft reform (Court of Cassation June 6, 2012)
A series of rulings on 6 June 2012 allows the Court of Cassation to take stock of moral harassment.
A definition centralized by the Penal Code: the Labour Code would no longer explicitly define moral harassment and would refer to the definition contained in the Penal Code. Limit of protection granted in the case of moral harassment: an employee who misrepresents acts of moral harassment in order to destabilize the company and dismiss the superior commits a fault justifying his dismissal.
Clarification on the system of proof: once an employee has established the materiality of the precise and concordant facts, the judge must make an overall assessment of these elements in order to decide whether there is a presumption of moral harassment.
The employer may be ordered to make good any damage suffered by an employee who is the victim of psychological harassment, but may also be ordered to pay compensation for the violation of his general obligation to prevent harassment. Double compensation is possible.
