In the law of bodily harm, a distinction must be drawn between damage, on the one hand, which is an attack on the physical or psychological integrity of the human person, and damage that can be made good, on the other hand, which is caused by an attack on the subjective rights of the person, whether they be economic or personal.

The same damage, i. e. the same injury, will not have the same consequences depending on the victim. This is the reason why the lawyer has to fight against any attempt at scaling up, in accordance with the principle of full compensation for damages.

In this respect, the DAMY Lawyers' Society had to deal with a school case, in this case that of the pianist whose car accident caused him significant pain in his wrist.

The victim was riding a motorcycle by the seaside when a cyclist decided to cross all lanes. The biker fell to the ground and was seriously wounded: bone detachment and dislocation of the right shoulder, eroded skin and multiple cutaneous wounds... Further examinations with a hand surgeon revealed a disjunction in the right wrist that required surgery.

The contradictory out-of-court assessment carried out by the insurance company made it possible to clinically ascertain all the damages, in particular the functional consequences at the level of the right hand and wrist.

The resulting damage consisted in a high professional impact because the practice of the piano becomes painful if prolonged.

Performing in the evenings in major hotels for sometimes more than 4 hours, this pianist could not play for more than an hour before his wrist became awkward. He could provide his service, but not without difficulty. This is in the interests of the position of prejudicial to the professional impact, which compensates in particular for the increased hardship in the victim's professional practice.

After hard negotiations between the DAMY Lawyers' Society and the opposing insurer, this pianist obtained an amicable payment of €60,000.00 for professional impact. By making use of his lawyer's expertise in this matter, he thus avoided litigation proceedings while obtaining satisfactory compensation.
